Mariotti, Old Forge, against the Pennsylvania Turnpike Commission, Harrisburg, and HMS Host Family Restaurants LLC, Middleton, Pennsylvania, over a slip and fall accident at the Hickory Run travel Plaza, 256 Danner Road, Jim Thorpe. A jury trial is demanded.The suit contends that on Jan. 11, 2015, Carol Mariotti was a business invitee on the premises owned by the Turnpike Commission and managed by HMS Host Family Restaurants, at which time slipped and fell due to a puddle of water, suffering severe and permanent personal injuries. The complaint claims her medical impairments and/or injuries and damages suffered by she and her husband are directly related to the tortuous actions of the defendants, which the suit contends, have a duty to keep the premises free from dangerous and hazardous conditions.Each of the defendants are seeking judgments in their favor on counts of negligence and loss of consortium that they filed against each of the defendants.Breach of note termsMaxine Baran, Sugarloaf, has filed an action that claims James Piskorick, Hazleton, is in breach of the terms of a judgment note he entered with the plaintiff on Oct. 25, 2012, in the amount of $8,000.The plaintiff claims payment of the note was due upon the sale of a premises located at 109 Church St., Beaver Meadows, by the defendant, who according to the terms of the note was supposed to pursue sale of the property on March 1, 2013, but has not done so, causing the breach.Judgment in the amount of $8,800, which includes 10 percent attorney's fees, is sought.Defaults on creditDiscovery Bank, New Albany, Ohio, has filed two actions against individuals it claims are in default of credit accounts with the plaintiff.The first action is against Stacie M. Rich, 784 Stony Mountain Road, Albrightsville, seeking judgment in the amount of $4,339.90, plus costs, and the second action lists Steven R. Zapella, 87 Yellow Run Road, Jim Thorpe, as the defendant, and seeks judgment in the amount of $9,768.55, plus costs.Complaint in ejectmentJohn F. and Mildred Person, 181 Brittany Drive, Albrightsville, have filed a complaint in ejectment against Neal T. and Dawn A. Gower and Andrew and Christopher Triola, 209 Patten Circle, Albrightsville. The complaint seeks an order of possession of the Patten Circle property, also known as Lot 131, Section A, Valley View Estates.The Persons claim they obtained ownership of the premises through a sheriff's sale as the result of a mortgage foreclosure action against the Gowers and that the Triolas, identified as grown sons of Mrs. Gower, are in possession of the property. The Persons state they made a claim for rent from the defendants, seeking $1,250 for the month of December, but the defendants have refused to pay the rent.There are three counts in the complaint, the first one seeking judgment in the amount of the rental request. The second count seeks an order of ejectment, while the third count seeks a claim not in excess of $40,000 for any damages that may have incurred at the residence.Quiet title actionsDavid Keller, 1933 Route 903, Jim Thorpe, has filed three separate quiet title actions, seeking court orders barring and enjoining defendants from having any claim or interest in properties the plaintiff says he purchased at the Carbon County Tax Claim Bureau's sale on Sept. 23.Defendants in one suit are Erik and Gail Thorson, Amherst, Ohio, concerning Lot A282, Towamensing Trails, Albrightsville, while the second action named Robbie Lynn and Patrick Paul Bloss, Mallory, New York, and involves a property at 121 Berwick St., Beaver Meadows.The third action lists William and Marianne Holden, Philadelphia, as the defendants, and involves Lot 80, South Lake Area, Bear Creek Lakes, Penn Forest Township.Municipal lienThe Nesquehoning Borough Authority, 114 W. Muniz, aka Michael Muniz, by and through Tammy L. Schaub, administrator of the estate, and in her own right, against Stacy and Wendy Peddigree, 285-52 Lower Nis Hollow Drive, Lehighton.The suit was filed by the plaintiff's attorney, Matthew G. Schnell, Palmerton, and was started by a request for a writ of summons, a legal procedure in which the specific basis of the case are not yet divulged.The filing, however, is on the basis of a wrongful death motor vehicle tort claim.
