Sues school district

A civil action has been filed against the Panther Valley School District, 1 Panther Way, Lansford, by a Blake Morgans.

The suit was started by the filing of a praecipe for a writ of summons by Attorney Joseph V. Sebelin Jr., Lehighton. The method effectively commences the civil action without listing the specific claims of the plaintiff.

The pleading indicates the action is an “other” tort case.

Appeals suspension

Natalia Louisa Casselli, 259 E. Catawissa St., Nesquehoning, has filed an appeal of the suspension of her driver’s license by the Commonwealth of Pennsylvania, Bureau of Driver Licensing, Harrisburg.

Her license was suspended for a period of one-year effective Aug. 29, 2020, due to her conviction on Nov. 7, 2019, for driving while her license was suspended or revoked.

The appellant contends the original case against her was “thrown out in court.”

Credit card defaults alleged

LVNV Funding LLC, Greenville, South Carolina, has filed four civil actions against separate defendants alleging credit card defaults.

One is against Kayla Crosson, 218 Nosirrah Road, Albrightsville, seeking judgment in the amount of $1,219.83, plus costs; the second seeks judgment of $1,474.94, plus costs, against James McMahon, 136 Holiday Drive, Albrightsville; the third action names Candis Aldana, 83 Mahoning Drive East, Lehighton, as the defendant, seeking judgment in the amount of $2,370.25, plus costs; and the fourth is against William Parks, 277 Main Road, Lehighton, seeking judgment in the amount of $3,228.58 plus costs.

Federal tax liens filed

The United States Internal Revenue Service, Cincinnati, Ohio, has filed judgments in three separate filings against people who owe individual tax returns (1040).

One judgment is against John J. and Cathryn A. Haber, 52 E. Market St., Tresckow, in the amount of $472,521.16, for taxes owed for 2016, 2017 and 2018.

The second judgment is against Michael A. Altamuro, 144 MacCauley Road, Albrightsville, in the amount of $13,313.33 that is owed for 2015.

The third judgment is against Daniel E. and Johanna Kepler, 63 Bayberry Road, Jim Thorpe, in the amount of $7,515.39 for taxes owed for 2018.

Judgments placed on record

Judgments ordered by county district magisterial judges were placed on record against the defendants.

• Ridgewood Country Estates, Pocono Lake, recorded a $6,745.94 judgment ordered by Magisterial District Judge Joseph Homanko on Oct. 24, 2019, in the amount of $6,745.94.

• Synchrony Bank, Canonsburg, placed on record two judgments, one against Maria Rieck, 1145 Broadview Drive, Jim Thorpe, and the other against Scott Mouery, 126 E. White St., Summit Hill. The judgment against Rieck is in the amount of $5,173.19 and was ordered by Magisterial District Judge Eric Schrantz on May 16, 2019. The judgment against Mouery is in the amount of $5,151.97 and was ordered by magisterial District Judge Casimir Kosciolek on July 15, 2019.

• Synchrony Bank, Canonsburg, has placed on record a judgment entered in its favor against Michele Rodweller, 330 Coal St., No. 1, Lehighton, in the amount of $2,267.87. The judgment was ordered by magisterial District Judge Eric Schrantz on June 6, 2019.

• James and Sherry Costenbader, 2905 Hahn’s Dairy Road, Palmerton, have placed on record a judgment entered in their favor against Karen Schlaner, 45 Moyer Place, in the amount of $6,348.15. The judgment regarding a residential lease was entered by magisterial District Judge William Kissner on Aug. 24, 2018.

• The Credit Acceptance Corporation, Cannonsburg, has placed on record two judgments that were ordered in its behalf.

One is against Bobbi Jo Shaffer, 333 Iron St., Lehighton. It was entered by Magisterial District Judge William Kissner on April 16, 2015, in the amount of $5,994.38.

The second judgment is against Kenneth J. Shafer, 820 Princeton Ave., Palmerton. It was entered by Magisterial District Judge William Kissner on May 14, 2014, in the amount of $5,328.10.

Mortgage foreclosures

Key Bank N.A., Brooklyn, Ohio, has filed a mortgage foreclosure complaint against Frank Juracka III, 106 E. Ridge St., Summit Hill, over a property at that address.

Sought is judgment in the amount of $71,487.02 plus costs and fees.

Nationstar Mortgage LLC, Coppell, Texas, has filed a mortgage foreclosure complaint against David J. Fulton Sr., 350 Hudsondale St., Weatherly, over a property at that address.

Sought is judgment in the amount of $116,788.28 plus interest, attorney’s fees and costs.

Partners for Payment Relief D.E. LLC, Eureka, California, has filed a mortgage foreclosure complaint against Edward F. and Caroline Coll, 623 E. Center St., Nesquehoning, over a property at that address. Sought is judgment in the amount of $96,064.25, plus interest, attorney’s fees and costs.

State liens filed

• The Commonwealth of Pennsylvania, Department of Revenue, Harrisburg, has filed a tax lien against Jarvis D. York, 314 W. Snyder Ave., Lansford, in the amount of $1,806.69. The lien is for use taxes owed for the period of Sept. 1-30, 2017.

• The Commonwealth of Pennsylvania, Department of Revenue, Harrisburg, has filed a tax lien against Robert L. Snyder, 219 Lehigh Ave., Palmerton, in the amount of $1,948.93. The lien is for personal income taxes owed for 2015.

• The Commonwealth of Pennsylvania, Department of Revenue, Harrisburg, has filed a tax lien against Zig’s Beverage LLC, 434 White St., rear, Weissport, in the amount of $3,373.89. The lien is for sales, use and hotel occupancy taxes owed for the period of May 1-31, 2019.

• The Commonwealth of Pennsylvania, Department of Revenue, Harrisburg, has filed three tax liens against Yosty’s Auto Service, 1101 North St., Jim Thorpe. One is in the amount of $2,710.81 for sales, use and hotel occupancy taxes owed for the period of June 1-30, 2019; the second one is in the amount of $4,570 for sales, use and hotel occupancy taxes owed for the period of Jan. 1-31, 2019; and the third lien is in the amount of $137.63 for employer withholding taxes owed for the period of July 1-Sept. 30, 2015.

• The Commonwealth of Pennsylvania, Department of Revenue, Harrisburg, has filed a tax lien against Wayne Kern, P.O. Box 158, Palmerton, in the amount of $2,122.68. The lien is for personal income taxes owed for 2016.

• The Commonwealth of Pennsylvania, Department of Revenue, Harrisburg, has filed a tax lien against Timothy L. Kostenbader, 1135 Summer Mountain Road, Palmerton, in the amount of $5,404.09. The lien is for personal income taxes owed for 2016.

• The Commonwealth of Pennsylvania, Department of Revenue, Harrisburg, has filed a tax lien against Meadow Landscaping Inc., 1458 Hudson Drive, Weatherly, in the amount of $4,295.96. The lien is for employer withholding taxes owed for the period of April 1-June 30, 2019.

• The Commonwealth of Pennsylvania, Department of Revenue, Harrisburg, has filed a tax lien against Michael Shubeck, 35 E. White St., Summit Hill, in the amount of $868.79. The lien is for personal income taxes owed for 2017.

Sues over rundown property

Robert Pecha, 119 E. Railroad St., Nesquehoning, as trustee for Robert Pecha Living Trust, same address, has filed a civil action against Thomas Robert Samuel, Nazareth, seeking several remedies for what the plaintiff alleges is a rundown property of his.

The suit states Samuel is the owner of a property at 121 E. Railroad St., next to Pecha’s home, that was allowed to deteriorate to the point that it is a health hazard and danger to neighbors, namely Pecha.

The plaintiff alleges the home is unsecured in that there are windows broken on it, it is infested with rats and other rodents, the roof leaks, and the property is in imminent danger of falling down.

The plaintiff asks the court to declare the structure a private nuisance and danger, directing the defendant to remove it or abate the nuisance; compensate the plaintiff for the costs of the action, for the diminution of his property value, and for medical expenses he incurred as a result of the deterioration of the property due to the extreme indifference of the defendant.
