Carbon County court

A Carbon County man was sentenced to a prison term on Friday on three pending charges he previously entered a guilty plea.

He was one of 13 defendants to be sentenced by Judge Joseph J. Matika, who had entered pleas at a prior proceeding.

Lausanne incident

Dwaine M. Solana II

, 42, of Weatherly, was sentenced to serve six to 12 months in the county prison on charges of DUI, simple assault and recklessly endangering another person.

He was arrested on Feb. 24 by state police at Hazleton in Lausanne Township.

Troopers responded to a residence along Buck Mountain Road for a neighbor dispute. The police report indicates that Solana displayed a gun and fired three shots in the air. He fled in a vehicle but was later stopped and found to be under the influence. He refused any testing.

Solana admitted being heavily intoxicated at the time of the incident. He also claimed he fired shots into the ground and not at the victim, as was indicated.

Matika told Solana, “You’re fortunate no one got hurt, or worst, killed.”

In addition to the prison term, Matika ordered Solana to render 25 hours of community service when paroled, get a drug and alcohol evaluation and follow any recommendation for treatment and have no contact with the victim. On the DUI count he was placed on probation for six months and ordered to pay a fine of $300.

He was given credit for 24 days already served and began the prison term immediately. He was granted work-release privileges.

Other sentencings

Randy Lee Edgar

, 37, of Lehighton, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000, one-year license suspension and render 25 hours of community service when paroled. On a charge of flight to avoid apprehension he was placed on probation for a year, concurrent with the DUI charge.

He was arrested on March 4 by Lehighton police along Second Street. Police made the initial stop to serve an arrest warrant on Edgar issued by the state parole board. He was found under the influence. A test revealed the presence of a controlled substance.

Edgar is currently an inmate in the state correctional institution at Mahanoy, Schuylkill County, awaiting action on a parole violation.

Ronald L. Carnes

, 26, of Slatington, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000, one-year license suspension and render 25 hours of community service.

He was arrested on Jan. 15 by state police at Lehighton along Route 248 in Parryville. A test revealed the presence of a controlled substance.

Jon Scott Snyder

, 20, of Palmerton, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000, one-year license suspension and render 25 hours of community service.

He was arrested on Nov. 14, 2017, by Palmerton police along Third Street, A test revealed the presence of a controlled substance.

He is currently in the county prison on pending criminal charges.

Reinaldo Magobet

, 43, of Albrightsville, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000, one-year license suspension and render 25 hours of community service. He was given credit for nine days already served on the sentenced and paroled.

He was arrested on Feb. 4 by state police at Fern Ridge along Route 903 in Penn Forest Township.

Magobet is currently an inmate in the county prison serving a nine to 23 months term imposed by Judge Steven R. Serfass on an assault charge.

Samantha J. Nedley

, 36, of Nesquehoning, was sentenced to serve 90 days to 60 months in prison, pay a fine of $1,500, license suspended for 18 months and render 100 hours of community service when paroled.

She was arrested on May 2, 2018, by Nesquehoning police along Catawissa Street. A test revealed the presence of a controlled substance.

She was given credit for six days already served. She will begin the prison term at 6 p.m. on Oct. 11 and serve it on consecutive blocks of three days at a time.

Rosemary Jean Delarosa

, 54, of Albrightsville, was sentenced to serve 30 days in prison followed by 59 months in the county’s Intermediate Punishment Program with the first 60 days on electronic monitoring, pay a fine of $1,500, license suspended for 18 months and render 100 hours of community service.

She was arrested on May 15, 2018, by state police at Fern Ridge along Pope Lane in Albrightsville. She refused a test.

She will begin serving the prison term at 8 a.m. on Oct. 11 and serve it in consecutive three-day blocks. She was given two days credit for time already served.

Trevor Austin Evans

, 26, of Lansford, was sentenced to serve 30 days in jail followed by 59 months in the county’s IPP, with the first 60 days on electronic monitoring, pay a fine of $1,500, license suspended for 18 months and render 100 hours of community service.

He was arrested on Sept. 20, 2018, by state police at Lehighton along Walnut Street in Lansford. A test revealed the presence of a controlled substance.

He will serve the jail term on consecutive two-day weekends beginning Oct. 7 at 11 a.m.

Kristin Nicole Eschbach

, 37, of Lehighton, was sentenced to serve 30 days in jail followed by 59 months in the county’s IPP with the first 60 days on electronic monitoring, pay a fine of $1,500, license suspended for 18 months and render 100 hours of community service.

She was arrested on Jan. 26 by Lehighton police along Route 443. A test revealed the presence of a controlled substance.

She will serve the prison term on consecutive two-day weekends beginning Oct. 7 at 8 a.m.

Francisco Demitri Rivera

, 26, of Allentown, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000, one-year license suspension and render 25 hours of community service. On a charge of driving under suspension he was fined $200.

He was arrested on June 18, 2017, along First Street by Lehighton police. A test revealed the presence of a controlled substance. He was previously placed in the county’s Accelerated Rehabilitation Disposition probation program but was revoked for violating conditions.

He will begin the jail term on Oct. 11 at 10 a.m.

Keith R. Straubinger

, 60, of Coaldale, was sentenced to serve two days in jail followed by five months in the IPP with the first 28 days on electronic monitoring, pay a fine of $750, license suspended for a year and render 25 hours of community service.

He was arrested on April 20 by Nesquehoning police along Route 54. A test revealed a 0.14 BAC.

He will begin the jail term at 9 a.m. on Oct. 6. The IPP will be supervised by Schuylkill County.

David Robert Snyder

, 64, of Palmerton, was placed in the IPP for six months with the first 15 days on electronic monitoring, pay a fine of $1,000, one year license suspension and render 25 hours of community service.

He was arrested on July 27, 2018, by state police at Lehighton along Route 248 in Lower Towamensing Township. A test revealed a 0.20 BAC.

Ihor Komarowski

, 79, of Philadelphia, and formerly of Lehighton, was sentenced to serve five days to six months in jail, pay a fine of $750, one-year license suspension and render 25 hours of community service.

He was arrested on Aug. 21, 2010, by Mahoning Township police along Beaver Run Road. A test revealed a 0.24 BAC. The case took a long time through the system because Komarowski could not be located.

He will begin the jail term at 9 a.m. on Sept. 29 and serve three days; and Oct. 4 at 9 a.m., serving two days.

Each defendant must also pay court costs of about $1,000, a $50 per month supervision fee while on probation or parole and follow any recommendation of their drug and alcohol evaluation.
