Schuylkill County Court

A man arrested three times by Tamaqua police in 2018 is headed to Schuylkill County Prison for six to 23 months, Schuylkill Judge John Domalakes ruled March 13.

Lester W. Dietrich

, 47, Tamaqua, was arrested by Tamaqua police July 12, Aug. 18 and Oct. 14. Tamaqua police officer Anthony Stanell charged Dietrich with receiving stolen property July 12. Officer Jeremy Sborz charged Dietrich with theft by unlawful taking and receiving stolen property Aug. 18. Officer Michael Hobbs charged Dietrich with criminal mischief, theft of motor vehicle, possession of drug paraphernalia and disorderly conduct Oct. 14.

Domolakes imposed the county prison sentence on the theft by unlawful taking arrest from August. The receiving stolen property charge was dropped. He must pay restitution of $1,835 to a victim, plus $100 to the CJEA. Dietrich will receive credit for 26 days served. After release, Dietrich will be on probation for 12 months for the July arrest and 12 months for the criminal mischief and possession of drug paraphernalia charges from the October arrest, with the probation sentences to run concurrently. The theft of motor vehicle and disorderly conduct charges from October were dropped. He must pay $100 to the substance abuse education fund and a $50 a month supervision fee.

Felix A. Tejeda,

37, Hazleton, arrested by Rush Township officer Ryan Oldt on May 10, 2018, and charged with three counts of theft by unlawful taking and three counts of access device fraud. Tejeda was sentenced to 11½ to 23½ months in county prison on each charge, to run concurrently. He must pay restitution totaling $7,520.19 to three injured parties. He received credit for 246 days served and was paroled. He must pay $50 to the CJEA, submit a DNA sample and have no contact with his victims.

Faylynne Harrison

, 34, Nesquehoning, was arrested by Tamaqua officer Thomas Rogers May 10, 2018, and charged with six counts of identity theft, two counts of theft by deception, receiving stolen property, two counts of forgery and access device fraud. She withdrew a prior plea of not guilty and pleaded guilty to one count of theft by deception. Her sentence is time served to 23 months, since she had already served the minimum sentence she was immediately paroled. She must pay $50 to the CJEA. The other charges were dropped.

Robert W. Fredericks

, 36, Tamaqua was arrested July 21, 2018, by Coaldale police officer James Bonner and charged with theft of secondary metal, receiving stolen property and criminal mischief. Domalakes sentenced Fredericks to three to 23 months in county prison on the theft of secondary metal charge, beginning March 30, with credit for seven days served. Fredericks must pay $1,500 restitution to a victim and $50 to the CJEA. The other charges were dropped.

Jacob R. Gaburick

, 30, Minersville, was arrested by Tamaqua police officer Karl Harig on April 10, 2018, and charged with aggravated assault, possessing an instrument of crime, prohibited offensive weapon, theft by unlawful taking, simple assault, criminal mischief and false ID to law enforcement. Gaburick was sentenced to time served to 23 months at the county prison on the prohibited offensive weapon charge; since he had already served the minimum sentence, he was immediately paroled. The other charges were dropped. He must pay $1,326.66 to a victim, plus $50 to the CJEA. He may have no contact with the victim.

Christina N. Petrosky

, 50, Hazleton, was arrested June 11, 2018, by Rush Township police officer Ryan Oldt and charged with two counts possession of a controlled substance and two counts use or possession of a controlled substance, and possession of a small amount of marijuana. Domalakes ordered that Petrosky be admitted to Drug Court effective March 14.
