Palmerton man gets state time

A former Palmerton man was sentenced to state prison Thursday on theft charges.

Alexander Ramirez, 40, formerly of Palmerton, pleaded guilty to one count of burglary and was immediately sentenced to a state prison.Ramirez admitted breaking into a residence along Coal St., in Lehighton, on Sept. 26, 2013, and removing various electronic items.Carbon County Judge Steven R. Serfass noted that Ramirez has a long prior criminal record which has placed him in prisons for some time. On Wednesday Ramirez was sentenced in Monroe County to serve five to 10 years in a state prison on similar type charges.Serfass sentenced him to serve 45 to 90 months in a state prison and ordered he make total restitution of $5,808, get both a drug and alcohol and mental health evaluations, and supply a DNA sample.Serfass agreed to go along with a plea bargain with the district attorney's office and Ramirez to run the jail term concurrent with the Monroe sentence.Other pleasOther defendants who entered guilty pleas included:Ryan E. Wurst, 26, of Jim Thorpe, pleaded guilty in two pending cases.He pleaded to one count of possession with intent to delivery a controlled substance-heroin. He was arrested on Oct. 18, 2013, by state police at Lehighton after a search warrant was served on his home at 22 Hopi Road, in Penn Forest Township. Found in the home were 46 bags of heroin.He also pleaded to one count of flight to avoid apprehension. He was arrested on that count on Nov. 13, 2013, when state police stopped a vehicle in Weissport that Wurst was a passenger. Troopers were aware of a warrant for his arrest. He fled on foot but was later caught.Serfass deferred sentencing and ordered the adult probation office prepare a presentence investigation report.Candy Lou Behler, 50, of Lehighton, pleaded to one count of possession of drug paraphernalia. She was arrested on March 18 by state police at Lehighton in the area of State Road and Fairview Street in Franklin Township following a traffic stop.Behler is currently serving a three to 18 months prison term imposed in Lehigh County for a probation violation. She also has a driving under the influence charge pending.Serfass placed her on probation for a year and ordered she get a D&A evaluation, zero tolerance for D&A use, and render 50 hours of community service when released from prison. The term runs consecutive to the Lehigh sentence.Nakai Linzy Moyer, 22, of Lancaster, and formerly of Lehighton, pleaded to one count of possession of drug paraphernalia. She was arrested on June 17, 2013, at 216 Carbon St., Lehighton, by borough police.Police responded to a report of a female unresponsive. Officer Matthew Bender arrived on scene and found Moyer is an upstairs bathroom not breathing. He performed CPR and revived Moyer.She told Serfass that Bender saved her life and that the experience caused her to enter a rehabilitation program in the Lancaster area which she successfully completed. She said plans to gain employment in that area and remain there.Serfass placed her on probation for a year and ordered her to get a D&A evaluation, zero tolerance for D&A use, and render 50 hours of community service.Kenneth G. Ahner, 57, of Lehighton, pleaded to one count of driving under the influence. He was arrested on Aug. 27, 2013, by Lehighton police along First St. Given a test, the result was .12BAC.Sentencing was deferred.Peter Bobita, 51, of Ashley, Luzerne County, pleaded to one count of DUI. He was arrested on Feb 26 by state police at Lehighton in Parryville. Given a test, the result was .20BAC.A first offense, Serfass placed him on probation for six months, and ordered he pay a fine of $300, get a D&A evaluation, and render 25 hours of community service.Patrick Green, 36, of Allentown, and formerly of Pocono Summit, pleaded to one count of DUI. He was arrested on May 25, 2013, by Lehighton police along First St. Given a test, the result was .19BAC.Serfass sentenced him to serve five days to six months in jail, pay a fine of $300, one year license suspension, get a D&A evaluation, and render 25 hours of community service.He was given credit for eight days spent in jail on the charge and was paroled.Sabrina L. Kulp, 35, of Jim Thorpe, pleaded to one count of DUI. She was arrested on June 7, 2013, by Mahoning Township police along Route 209. Police responded to a report of a suspicious vehicle in the area.Serfass deferred sentencing so Kulp could apply for placement in the Intermediate Punishment Program.Edward Arthur Wilson, 48, of Lehighton, pleaded to one count of DUI. He was arrested on Sept. 1, 2013, along Main Road, in Franklin Township by state police at Lehighton. Given a test, the result was 0.25BAC.Serfass placed him on probation for six months and ordered he get a D&A evaluation, pay a fine of $300, and render 25 hours of community service.Jessi A. Feney, 19, of Lansford, pleaded to one count of DUI. She was arrested on March 30, 2013, at Route 209 and Market St., by Nesquehoning police after being involved in an accident. Given a test, the result was 0.17BAC and also showed the presence of a controlled substance. Feney is currently serving a 90-day prison term imposed by a district judge.Serfass sentenced her to serve 48 hours to six months in jail, a fine of $1,000, one year license suspension, get a D&A evaluation, and render 25 hours of community service when released on bailThe prison term runs consecutive to her current sentence.Each defendant sentenced must also pay court costs, which average about $1,000, and pay a $50 per month supervision fee while on probation or parole.
