Carbon County court — ARD

A Carbon County woman who did damage to a cemetery and a tombstone was placed in Carbon County’s Accelerated Rehabilitation Disposition probation program on Tuesday.

She was one of four placed in the program by Judge Joseph J. Matika.

Cemetery incident

Jennifer Lynn Swolensky,

26, of Palmerton, was placed for a year on charges of criminal mischief, institutional vandalism and summary offenses of disorderly conduct and scattering rubbish.

She was charged by state police at Lehighton for incidents on Jan. 30 at St. Vladimir’s cemetery located off Fireline Road in Lower Towamensing Township.

A family member of the deceased person told the court she was initially opposed to the ARD placement but has since changed her mind. She said she hoped Swolensky realizes what she had done and how wrong it was. Damage to the stone was estimated at $400.

Matika also ordered Swolensky to pay $450 for the cost of the program, get both drug and alcohol and mental health evaluations and follow any recommendations for treatment, make restitution of $400, stay off the cemetery property, render 50 hours of community service and write a letter of apology to the family affected by her actions.

Matika told her that had the family member objected to the ARD placement, he would not have approved it.

Also placed in the program were:

Kylan Michael Julien,

20, of Brooklyn, New York, was placed for a year on a charge of possession of a small amount of marijuana. He was arrested on July 4 by state police at Hazleton along Hudson Drive in Packer Township.

He was assessed $450, ordered to render 50 hours of community service.

Brittany Michelle Leebenbow,

19, of Brooklyn, New York, was placed for nine months on a charge of possession of a small amount of marijuana. She was arrested with Julien.

She was assessed $450, ordered to render 25 hours of community service.

Catherine Elizabeth Comaianni,

27, of Albrightsville, was placed for six months on a charge of possession of drug paraphernalia. She was arrested on Nov. 14, 2018, by state police at Fern Ridge along Route 903 in Kidder Township.

She was assessed $650 and ordered to get a drug and alcohol evaluation and render 25 hours of community service.

Each defendant must pay court costs of about $1,000 and a $50 per month supervision fee while in the program.
