Man gets jail for DUI with juvenile in his vehicle

A Lansford man was given a county prison term on Monday for drunken driving while having a juvenile in his vehicle.

However, the prison term was considerably less than state sentencing guidelines recommended.Judge Joseph J. Matika sentenced Jesse G. Marshall, 44, to serve a total of 90 days in prison followed by 15 months in the county's Intermediate Punishment Program, the first six months on electronic monitoring.At a previous guilty plea hearing, Marshall was told he faced nine to 16 months minimum in prison based on his prior record score.Matika noted he was going outside the recommended minimum because the crimes that created the recommended guideline sentence occurred over 25 years ago.He added, "Your prior record score will always shadow you. Your past crimes will come back to haunt you."Matika rejected a request from defense attorney Matthew J. Rapa to impose a sentence of IPP without any jail time.Matika said that would send the wrong message to the public in a case in which a person was drinking and driving with a juvenile in the vehicle.Marshall was arrested on Feb. 5, 2015, along Bertsch Street in Lansford by state police at Lehighton. A test showed the presence of a controlled substance.A 13-year-old female was in the vehicle at the time. He pleaded to one count each of DUI and endangering the welfare of a child.Marshall told Matika, "I'm truly embarrassed. I don't want to hurt my kids."In addition to the prison term, Marshall must pay a fine of $1,500, have his license suspended for 18 months, render a total of 100 hours of community service when he completes his prison term, pay court costs of about $1,000, and pay a $50 per month supervision fee while on parole and probation.He will begin the jail term at 9 a.m. April 2 and serve it on consecutive three-day periods each week.
