New Ringgold man gets jail term for DUI charge

A New Ringold man began a 72 hours sentence Monday in the Schuylkill County prison after entering a guilty plea last week in the county court to a driving under the influence (DUI) of alcohol charge.

Samuel Leon Fry, also known as Samuel Frey, 29, of 79 Goose Pond Road, was sentenced by Judge John E. Domalakes to serve 72 hours to six months in prison and to be immediately paroled on completion of his minimum time for the balance of his sentence. He also must pay a fine of $1,000, pay $300 to Substance Abuse Education (SAE) fund, $50 to Catastrophe fund, make restitution of $60 to Schuylkill Medical Center and $113 to Bethlehem Regional Lab, attend alcohol highway safety school, receive intensive outpatient substance abuse counciling and his driver's license is suspended 12 months.He also pleaded guilty to possession of drug paraphernalia and was sentenced to serve an additional 12 months on probation consecutive to the DUI sentence. Fry was cited by Patrolman Gregory Meisner, Schuylkill Haven police last Jan. 22.Judge Domalakes also sentenced 19 others who entered guilty pleas to criminal charges.Dan Franklin Whalen, 49, Schuylkill Haven, on a DUI charge was sentenced to serve 72 hours to six months in the county prison and granted immediate parole on completion of his minimum time, pay a fine of $1,000, pay $300 to SAE fund, $50 to Catastrophe fund, attend safe school, pay $60 to Schuylkill Medical Center, and license suspended 12 months. On a summary charge of failing to carry car insurance was fined $300 plus costs. He was cited last January 21 by Patrolman Meisner, Schuylkill Haven police.Whalen also pleaded guilty to corruption of minors and was sentenced to serve 23 months on probation to run concurrent with the DUI sentence and on two counts of selling for furnishing alcohol beverages to minors was fined $2,000 plus costs. He was cited by Trooper Thomas J. Robin last March 12.Basilio Lebron Dejesus, 43, Hegins, on a DUI charge was sentenced to serve 30 days to 12 months in the county prison, pay a fine of $1,000, pay $300 to SAE fund, $50 to Catastrophe fund, $60 to Schuylkill Medical Center, attend schooling, receive intenstive outpatient counseling and license suspended 12 months. On charges of failing to drive on roadway laned for traffic and failing to drive at safe speed was fined $50 plus costs.Crystal Marie Weikel, 33, Sacramento, Hubley Township, on a charge of defrauding secured creditors was placed on probation for 23 months, pay $50 to CJEA and must make restitution of $6,023. The restitution is jointly owed with her husband, David Weitzel and Gratz National Bank. On a charge of theft was placed on probation 18 months concurrent with the first sentence, pay $50 to CJEA and must make restitutiion of $750 to Theresa Louise Chiesa, Barry Township, and $944.54 to Erie Insurance Company. She was cited by Trooper Bernard Spece, Jr..Christopher Scott George, 32, Tower City, for possession of a small amount of marijuana and drug paraphernalia was placed on probation 12 months, pay $100 to SAE fund, $50 to CJEA and make restitution of $113 to Bethlehem Regional Lab.Zachary Daniel Shaw, 19, Schuylkill Haven, on three counts of terroristic threats made to three individuals in Orwigsburg was placed on probation 12 months, pay $50 to CJEA attend Anger Management classes and undergo a drug and alcohol evaluation.Butch Harry Aungst, 24, Pine Grove, on a charge of possession of a controlled substance was placed on probation 12 months, pay $100 to SAE fund, $50 to CJEA and make restitution of $113 to Bethlehem Regional Lab. He was cited byTrooper Michel Lane last Jan. 21 in Pine Grove Township.Daniel E. Wenrich, 36, Pine Grove, on charges of possession of drug paraphernalia and a small amount of marijuana was placed on probation 12 months, pay $100 to SAE fund, $50 to CJEA and make restitution of $113 to Bethlehem Regional Lab. He was cited by Det. Thomas Trotter IV, PIne Grove police, last Feb. 21.Harry L. Confair Jr., 46, Pine Grove, pleaded guilty to a number of charges arising following his apprehension following a chase by police last January. On a charge of simple assault he was sentenced to serve one to 23 months in the county prison with credit for serving one day; pay $50 to CJEA and make restitution of $4,953.38 to Tremont Borough for damage to a police car and $3,143.83 to EMC Insurance Company.On a charge of failing to have car insurance was fined $300, recklessly driving, $200, driving while his car registration was suspended, $100 and careless driving, $25 plus $200 in costs.On chages of fleeing police and criminal mischief was placed on probation for 12 months to run concurrent and on two counts of recklessly endangering another person drew a sentence of one to 23 months in prison to run concurrent.Debra Jean Fidler, 55, Pine Grove, on a DUI charge served 48 hours in the county prison over the weekend and is now on parole for six months, fined $500, pay $100 to SAE fund, $50 to Catastrophe fund, $60 to Schuylkill Medical Center, complete safety school, receive intensive outpatient substance abuse counseling and license suspended 12 months. On a charge of failing to drive on right side of road was fined $25 plus $50 costs. She was cited by Cpl. Jeffrey Futchko, Pine Grove police, last Jan. 23.John Alfred Haller, 60, Schuylkill Haven, on a charge of theft of mail from the mail box of Ronald Boyer, Union Street, was placed on probation 12 months and pay $50 to CJEA.Sean Lee Lubold, l22, Lykens, on a DUI charge served 72 hours over the weekend in the county prison and is now on parole for six months, was fined $1,000, pay $300 to SAE fund, $50 to Catastrophe fund, attend safety school, receive outpatient substance abuse counseling, pay $60 to Schuylkill Medical Center and license suspended 12 months. On charges of failing to drive on roadway laned for traffic and failing to give police immediate notice of an accident was fined $50 plus $100 costs. Lubold was cited by Trooper Eric Reber following an accident on Fearnot Road in Hubley Township last Dec. 12.Bobbie Jo Machamer, 35, Tower City, charged with delivery of a controlled substance in his home town was sentenced to serve one to two years in a state correctional institution with credit for serving 24 days in the county prison, pay $100 to SAE fund, $50 to CJEA and make restitution of $165 to Tower City Police and $113 to Bethlehem Regional Lab.Brandon P. Miller, 19, Port Clinton, on a charge of criminal trespass on property in Schuylkill Haven, was placed on probation 12 months, pay $100 to SAE fund, $50 to CJEA and make restituiton of $113 to Bethlehem Regional Lab. On a charge of possession of a small amount of marijuana must serve an additional 30 days on probation.Marguerite J. Murphy, 43, Pottsville, on four charges of forgery and theft was placed on probation for four years, pay $50 to CJEA and make restitution of $15,600 to Richard Rohrer, of Grimms Variety Store, Philadelphia. Murphy was cited Sgt. John Koury, Orwigsburg police.Eric Robert Shappell, 25, Seltzer, Norwegian Township, on a charge of corruption of minors was given credit for serving four days in the county prison and was placed on parole for 12 months, pay $50 to CJEA and $50 to the district attorney's office for a bench warrant. On a chage of selling or furnishing alcohol beverages to minors was fined $1,000. On a charge of theft was given an additional 18 months on probation and make restitution of $340 to the victim.Sherwood Starnowsky, 61, Schuylkill Haven, on charges of corruption of minors and indecent assault was placed on probation five years and subjected to sex offender condtions pertaining to minor victims and pay $50 to CJEA.Sonya Rachel White, 27, Tower City, on a charge of criminal mischief for kicking the car door of Matthew Morgan, Tower City, was placed on probation 12 months, pay $50 to CJEA and make restitution of $622.64 to the victim. On a charge of disorderly conduct was fined $25 and $50 costs. White was cited by Patrolman Rodd Harring, Tower City police.David Wilson, 24, Pine Grove, for possessing a controlled substance when stopped on Pleasant Valley Road, Pine Grove Township, was put on probation 12 months, pay $100 to SAE fund, $50 to CJEA and make restitution of $113 to Bethlehem Regional Lab.James Andrews Whiteman, 20, Tower City, for theft of a stereo set from a motor vehicle in Tower City was placed on probation 12 months and pay $50 to CJEA. On a charge of criminal mischief was fined $100 and costs.Each defendant must also pay court costs and a $50 per month supervision fee while on probation or parole.
