Lehighton man admits sexual assault incident

A Lehighton man admitted in Carbon County court on Thursday to a charge of indecent assault on an unconscious person.

Joel Burgos, 33, entered his plea before President Judge Roger N. Nanovic II for an incident on May 29.Lehighton police were dispatched to a house along Center Alley for a report of a sexual assault incident.On scene, the officers were told by the female victim that Burgos had made inappropriate contact of a sexual nature with her as she was sleeping in a downstairs bed.She said she was at the residence with her boyfriend and others when Burgos arrived. She and the others were afraid of Burgos, stating they knew he was a "gang member."She said her boyfriend left and she fell asleep. She said she woke up to find Burgos on top of her and touching her in her private area.She said she pretended to be asleep because of her fear of Burgos.In exchange for the plea, the district attorney's office agreed to drop charges of involuntary deviate sexual intercourse, sexual assault and aggravated indecent assault, all felonies. The indecent assault count is a misdemeanor one.Nanovic deferred sentencing because the charge falls under the provisions of Megan's Law. Burgos will be evaluated by the state sexual assessment board to determine if he is a violent sexual predator. If he is, he will have to register for life as a sexual offender. If not, Nanovic said the registration period for the charge is 25 years.Nanovic also ordered the adult probation office to prepare a presentence investigation report.
