Lehighton man faces charges

Scott Schulte, 22, of 285-46 Lower Nis Hollow, Lehighton, faces charges from an incident which took place at 11:31 p.m. March 30, 2010, in Lansford.

Charges of driving under the influence (DUI), accidents involving damage to unattended vehicle or property, and careless driving were filed by Officer Jeffrey Ohl.According to an affidavit of probable cause, here's what happened:Ohl was dispatched to a hit-and-run to a parked vehicle in the area of West Ridge and Cortright streets.Upon arrival, he spoke to the complainant, who told Ohl that she saw a small white car pull out of a parking space in the 300 block of West Ridge Street at a high rate of speed, then attempt to turn left onto Cortright, but failed to negotiate the turn and hit a parked car and a garage.The woman said the white car backed out and proceeded to travel down West Ridge toward Dock Street.Ohl saw heavy structural damage to the garage, but did not see any damage to the vehicle that was parked nearby.While talking with the complainant, he noticed a car that fit the woman's description of the striking vehicle drive by.He stopped the car, a white Volkswagen Rabbit, in the 300 block of West Ridge.He spoke with the driver and sole occupant, who was identified by his driver's license as Schulte.Ohl smelled alcohol coming from Schulte's breath and that Schulte's eyes were red and glassy. He asked Schulte where he was coming from, and Schulte answered, "a friend's house."Schulte could not identify who the friend was or where the person lived, and denied having been in the area prior to the traffic stop.Ohl asked him if he had had any alcoholic beverages that evening, and Schulte said he had not. Schulte agreed to take field sobriety tests, but failed them due to poor balance, coordination and the inability to perform the tests as instructed.After Schulte completed the tests, Ohl was approached by another neighbor who said he had seen the incident occur as well, and positively identified the Volkswagen and Schulte as the driver.Ohl arrested Schulte, who agreed to have blood drawn for an alcohol test.Schulte was taken to St. Luke's Miners Memorial Hospital, Coaldale, where his blood was tested.The test revealed a blood alcohol content of 0.24 percent. A level of 0.08 percent is the threshold for impaired driving.Schulte's blood also tested positive for the presence of opiates.On Oct. 4, Ohl received a copy of an estimate for the damage to the garage from its owner in the amount of $13,800.
