James S. and Carol L. Snyder, 1156 Smith Lane, Lehighton, filed a civil action against the following: Larry Smith, dba, Smith Inspection Services and L&L Pest Control, of Box 48, Brodheadsville, and Gerald and Angie Berry, 51 Fairway South, Penn Mountain Estate, Lehighton.
The suit states that the plaintiffs and the Berrys' entered into a standard agreement of sale for real estatee at 179 Laurel Springs Rd., East Penn Township, Lehighton, on April 11. The suit further states Berry signed a real estate disclosure form, as required by state law, concerning the property.
On April 15 the plaintiffs entered into a valid home inspection contract with Smith for a log cabin home on the property to be purchased. The parties relied on the inspection performed by Smith and did purchase the property on May 29.
The suit claims the inspection failed to show wood destroying insects present in the structure. It further claims Smith only revealed finding dead insects not live ones. The suit claims live insects damaged the property.
Negligence is alleged against Smith and his firm and fraudulent representation is alleged against the Berrys. Sought are damages in excess of $15,000 and lost of home rental of $2,800 against all defendants.
