Schuylkill County Court

A Tamaqua man charged with prohibited possession of a firearm is headed to state prison, in a ruling by Judge Cyrus Palmer Dolbin July 15.

, 37, was arrested by Schuylkill County Sheriff’s officer William Allar on Aug. 20, 2018. Eberts was sentenced to 24 to 48 months at a state correctional facility, with his sentence to begin Aug. 1. He must submit a DNA sample and pay the $250 fee.

A Tamaqua man has violated conditions of his probation, according to a ruling made by Schuylkill County Judge Charles Miller July 9.

Phillip G. Brinich

, 39, was arrested by Tamaqua Police on Aug. 23, 2018, and charged with use or possession of drug paraphernalia. Brinich must pay the fines, costs and assessments originally imposed, and has been resentenced to serve 4-12 months in Schuylkill County Prison.

In a ruling July 10, Miller admitted Lillian Birkmier

, 50, Tamaqua, into the Accelerated Rehabilitation Disposition probation program for first-time offenders. If a person successfully completes all conditions of the program their record will be wiped clean. However, if they fail to complete it, or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.

Birkmier was arrested by West Penn Township on Nov. 28, 2016, and charged with four counts theft by unlawful taking, four counts receiving stolen property, criminal theft by unlawful taking and criminal receiving stolen property. Birkmier must pay $403.44 restitution to EZ Market in New Ringgold. She must pay court costs and fees, $50 a month supervision fee while she is on probation for 12 months and she must perform 10 hours community service.

In a decision by Judge John Domalakes June 27, Trevor Farley

, 40, Mount Carmel was sentenced to 6-23 months in county prison. Farley was arrested by Coaldale Police on April 14, 2017, and charged with two counts possession of a controlled substance and possession of drug paraphernalia. On the possession of controlled substance charge, Farley must pay court costs and fees. He will be on probation 6-23 months, concurrent with the county prison sentence.

In a decision July 3, President Judge William E. Baldwin admitted Samson Z. Walton

, 25, Weatherly, into the Intermediate Punishment Program. Walton was arrested June 21, 2018, by Rush Township Police and charged with DUI and resisting arrest.

On the DUI charge, Walton must spend the first 25 days on house arrest with electronic surveillance, followed by 35 days strict supervision and four months on probation. He must pay court costs and fees, he must complete alcohol highway safety school, must do 20 hours community service, and his license will be suspended for 12 months, followed by a 12-month ignition interlock. On the resisting arrest charge, Walton will be on probation for 12 months.

In a ruling by Judge Baldwin on July 16, the probation for Marshall M. Barker

, 25, Tamaqua, was revoked. Barker had been arrested by Pottsville Police on Nov. 15, 2017, on a criminal trespass charge. He pleaded guilty to the charge March 16, receiving a sentence of three to 23 months plus 12 months on probation. Baldwin resentenced him to serve three to 12 months, with credit for time served since May 19 to present, followed by 12 months on probation.
