Complaint in partition

Michael Cusanelli and Robert Cusanelli, who reside at 276 Maple Ave., Lehighton, have filed a complaint in partition against Diane Shank, Carlisle, asking the court to enter an order requiring the defendant to sell her interest in the property at the above-stated Lehighton address to them.

The complaint states the three individuals own 33-1/3 percent of the property each and that Shank does not live there and does not contribute to the monthly bills of the property.

It states the plaintiffs secured an appraisal of the property and sent the defendant a check for $86,666 to Shank to buy her interest in it, but Shank has rejected the offer and refuses to sell her interests.

Sues after accident injuries

Matthew Steven Gallman, 271 Patten Circle, Albrightsville, has filed a civil action against Martin J. Bach, 272 Patten Circle, seeking damages in excess of $50,000 in a claim of negligence for an accident in which the plaintiff sustained serious injuries.

In the complaint, which seeks a jury trial, Gallman states he was a passenger in a 2012 truck that Bach was operating on Aug. 23, 2021, that crashed off Rt. 903 in Penn Forest Township. Gallman alleges Bach swerved into an embankment off the right shoulder of the highway in an attempt to avoid crashing into a stopped vehicle. The suit says the truck struck a rock, overturning and skidding across the northbound lane of travel, striking another vehicle. Both Gallman and Bach had to be extricated from the vehicle, the suit states.

The count of negligence alleges, among other things, that Bach failed to maintain proper and adequate control of the vehicle, was traveling too fast for conditions, and failed to use due care for the safety of the plaintiff, resulting in him sustaining serious and painful injuries that require continuing treatment and medical care.

Tax liens filed

The U.S. Internal Revenue Service, Detroit, Michigan, was filed a federal tax lien against Noel and Malia Torres, 134 Skye Drive, Lake Harmony.

The lien is in the amount of $58,374.97 and represents 1040 (personal income) taxes owed for tax periods ending Dec. 31, 2018 through 2021.

The IRS has filed a lien against the Palmerton Preschool and Childcare Center, 208 Delaware Ave.

The lien is in the amount of $14,301.46 and represents 941 (employer federal) taxes owed for tax periods ending June 30, 2019 and June 30, 2022.

Mortgage foreclosures

The Bank of America, N.A., Plano, Texas, has filed a mortgage foreclosure complaint against Richard D. Steinmetz, 126 Robertson Road, Jim Thorpe, over a property at that address. Sought is judgment in the amount of $53,987.19, plus costs and attorney’s fees.

Finance of America Mortgage, N.A., Horsham, has filed a mortgage foreclosure complaint against John A. Christman, 888 East Princeton Ave., Palmerton, over a property at that address. Sought is judgment in the amount of $177,461.67, plus costs and attorney’s fees.

Caliber Home Loans, Inc., Greenville, South Carolina, has filed a mortgage foreclosure complaint against Michael J. Eatman and Anecqua Sharee Eatman, 1250 Station St., Lehighton, over a property at that address. Sought is judgment in the amount of $406,164.39, plus costs and attorney’s fees.

The New Tripoli Bank, 7747 Claussville Road, Orefield, has filed a mortgage foreclosure complaint against Alexander J. Riepensell, Allentown, over a property at 123 Jamestown St., Lehighton. Sought is judgment in the amount of $42,015.25.

Defaults on credit

J.P. Morgan Chase Bank, N.A., Mechanicsburg, has filed a credit card debt collection action against Derek Seidler, 77 Piney Woods Drive, Jim Thorpe.

Sought is judgment in the amount of $11,219.95.

Transcripts of judgments

Judgment awards (transcripts) in their favor have been placed on record by parties of cases heard in the magisterial district judge courts.

The Kemmerer Memorial Park Center, 237 W. Broadway, Jim Thorpe, recorded a judgment in its favor against Jason DeMarco, 20 Packer Hill Jim Thorpe. The judgment is $1,139 was ordered by MDJ Eric M. Schrantz, Jim Thorpe, on Dec. 2, 2022.

Midland Credit Management, Inc., Catonsville, Maryland, recorded a judgment in its favor against Joan E. Walsh, 695 Spring Mountain Road, Weatherly. The judgment in the amount of $5,972.84 was ordered by MDJ Joseph D. Homanko Sr., Weatherly, on April 29, 2022.

Midland recorded a judgment in its favor against Rafael Rodriguez Jr., 107 Alum St., Lehighton. The judgment in the amount of $5,170.06 was ordered by MDJ Schrantz on Dec. 6, 2021.

The Meadows at Lehigh Valley, L.P., Branchburg, New Jersey, recorded a judgment in its favor against Julia Cassetta, 63 W. Broadway, Jim Thorpe. The judgment in the amount of $4,294.18 was ordered by Northampton County MDJ Vivian I. Zumas of Bethlehem on June 22, 2022.

Municipal liens filed

The Lehighton Water Authority has filed municipal liens against two people who it claims have outstanding water bills.

The first lien is against Terry Fisher, Easton, for a property at 430 White St., Weissport, seeking $663.06 for an outstanding bill from January through November of this year and filing and attorney fees.

The second lien is against Alexander Riepesell, Allentown, for a property at 123 Jamestown St., seeking $920.18 for an outstanding bill from November 2021 through November 2022 and filing and attorney fees.
