Police: Weatherly alumni president charged over $11K in personal expenses

Police say a Weatherly man who served as president of the Weatherly Area High School Alumni Association charged over $11,000 in personal expenditures to an alumni credit card.

Todd Gimbi, 57, used the money on Major League Baseball tickets, hair restoration treatments, dental visits and more, according to court records.

According to the affidavit of probable cause filed by Sgt. Michael C. Bogart of the Weatherly Police Department:

On Feb. 5, Jennifer O’Donnell, the liaison between the Weatherly Area High School Alumni Association and the Weatherly Police Department, brought statements from the BB&T Bank where the alumni hold an account.

O’Donnell, treasurer of the alumni association, told Bogart that they had discovered that a BB&T business credit card was opened in the Weatherly Area High School Alumni Association name without any consent or knowledge from the board.

O’Donnell also said that BB&T took $11,182 out of their association account (ending in 1266) to cover and zero out the balance of the credit card due to it not being paid on and being in default.

The statements for the credit card lists transaction dates started Dec. 11, 2018, and ran through Nov. 22, 2019.

The credit card lists Gimbi and the Weatherly Area High School Alumni Association as the card holder.

Bogart requested a subpoena for a copy of the credit card application that was signed by Gimbi from the BB&T Bank, and received a copy of the BB&T business credit application that was dated Oct. 12, 2018, and signed by Gimbi.

The application was signed by Gimbi and dated Oct. 12, 2018, just below the business name of Weatherly Area High School Alumni Association.

The first charge on the credit card was on Dec. 12, 2018, in the amount of $1,963 at a Hertz Rent-A-Car in Hazleton. The last charge before the bank shut down the card was on June 25, 2019, in the amount of $41 at a Turkey Hill in Hazleton.

In total, Gimbi used the credit card 155 times, which included more rental cars, airline tickets, hotel rooms, Major League Baseball tickets, phone bills, home heating fuel, car insurance payments, shopping at high end stores, hair restoration treatments, dental visits, multiple online stores, check centers to get cash, gas station and multiple restaurants and fast food places around the area.

O’Donnell told Bogart that Gimbi had no authorization to open a credit card in the Weatherly Area High School Alumni Association name, nor charge any of the charges listed to the association.

O’Donnell, along with Ronald Bittner, chairman of the finance committee of the Alumni, contacted Gimbi via email and text after they found out about the credit card and its default status.

In those conversations, Gimbi claimed that the card was his and the bank messed up.

O’Donnell told Bogart that she was in contact with BB&T Bank in Hazleton and they advised her that Gimbi was in that branch inquiring about getting a loan in the Weatherly Area High School Alumni Association’s name.

On May 5 Bogart contacted Gimbi and asked him to come to the station and speak with him.

Gimbi told Bogart he thought the card was his and not the association’s and did so because the bank kept calling him to open an account and he finally agreed.

Gimbi faces charges of forgery, access device fraud, and deceptive business practice.

He is currently incarcerated in the Carbon County Correctional Facility in lieu of $5,000 bail, and scheduled to have a preliminary hearing June 10 before District Judge Joseph D. Homanko Sr. of Weatherly.

The association released a statement in early May saying that the board had removed Gimbi from office of president and committee affiliations. The association has retained an attorney to recover the funds.
