Hearing on vote recount in DA race resumes

A hearing was scheduled to resumed this morning in Schuylkill County court on the election challenge to the vote results for the contest of district attorney.

Supporters of incumbent District Attorney Karen Byrnes Noon filed a petition for a recount of the county wide paper ballots, including the absentee and overseas vote, on grounds they allege an error was committed in the counting of absentee ballots.The official count made by a computing board following the Nov. 5 General Election gave attorney Christine Holman a 63-vote victory over Noon. The computing board announced Holman received 15,265 votes and Noon, 15,192.The hearing is a continuation of one held before President Judge William E. Baldwin on Tuesday. At that proceeding, the petitioners presenting testimony to show that the counting of the ballots was inaccurate and did not show the true number of absentee votes cast for each candidate. At the Tuesday hearing Baldwin denied Holman's attorney's motion to quash the charges and allowed Noon's counsel to amend the complaint. The hearing today is on the amended complaint.Supporters of Holman filed a response to the suit Thursday afternoon in the prothonotary's office seeking to quash the motion on grounds the action against Holman was brought without cause because the technical defects experienced in the counting of about 30 absentee ballots by scanner machines were remedied. They also claim they fail to cite any fraud or illegality as required by the election code.
