Seven placed in probation program

Seven defendants in pending criminal cases were placed in Carbon County's Accelerated Rehabilitation Disposition (ARD) probation program for first time offenders on Tuesday.

If a person successfully completes all conditions of the program their record is wiped clean. However, if they fail to complete the program, or are revoked from it, they will face trial on all pending charges. A person does not admit guilty in entering the program.All were placed by Judge Joseph J. Matika for a year, unless otherwise noted.Nicholas A. Brogan, 19, of Palmerton, was placed on a charge of access device fraud and theft of a motor vehicle, in two pending cases. He was arrested by Mahoning Township police for the access device fraud case for an incident at the Walmart store using a credit card without permission. The theft of vehicle count stems from a Aug. 25, 2012, incident involving Tara Spiker as the victim and Palmerton police making the arrest.He was assessed $650 for the cost of the program, and ordered to make restitution of $90.08, and render 50 hours of community service.Emily Anne Fatzinger, 21, of Palmerton, was placed for two years on a charge of criminal conspiracy-theft, receiving stolen property, and forgery in three pending cases. She was arrested for her part in the theft from relative Lisa Fatzinger occurring on July 26, 2012. The second case involved Robert McFarland and the victim and taken was items from his residence. The third case involved Lisa Fatzinger again.She was assessed $650, and ordered to make total restitution of $817.57, which is her share divided with other co-defendants.Moises Flores, 19, of Nesquehoning, was placed on a corruption of minors charge. He was arrested by Nesquehoning police for supplying marijuana to a 15-year-old male on Nov. 18, 2012, in an area along Willow Lane.He was assessed $450, and ordered to render 50 hours of community service.Bradley Matthew McFadden, 26, of Philadelphia, was placed on a driving under the influence (DUI) charge. He was arrested on Oct. 21, 2012, along SR903 in Kidder Township, by state police at Fern Ridge. Given a test, the result was .19BAC.He was assessed $500, and ordered to get a drug and alcohol (D&A) evaluation and follow any recommedation for treatment, license suspended for 60 days, and render 50 hours of community service.Bradley Lee Oberlander, 53, of Palmerton, was placed on a DUI charge. He was arrested on Dec. 23, 2012, by state police at Lehighton along Delaware Avenue in Palmerton. Given a test, the result was .19BAC.He was assessed $550, and ordered toget a D&A evaluation, license suspended for 90 days, and render 50 hours of community service.Thomas J. Salzer, 19, of Hazleton, was placed on a DUI charge. He was arrested on Oct. 23, 2012, along Berwick St., by Beaver Meadows police. Given a test, the result showed the presence of a controlled substance.He was assessed $600, and ordered to get a D&A evaluation, license suspended fro 90 days, and render 50 hours of community service.Chad M. Sateach, 18, of Beaver Meadows, was placed for six months on a charge of possession of marijuana. He was arrested on Nov. 17, 2012, along Third St., by Beaver Meadows police.He was assessed $450, and ordered to render 25 hours of community service.All defendants placed must also pay court costs, which average close fo $1,000, and pay a $50 per month supervision fee while in the program.
