A Nesquehoning man was one of five people who were removed from the Accelerated Rehabilative Disposition (ARD) probation program by Senior Judge D. Michael Stine in Schuylkill County court.

Leonard E. Rahatchek III, 23, of 219 Stock St., Nesquehoning, had his participation in the program terminated and returned to the trial list.He was removed from probation for violating four rules he was instructed by the court to follow including failure to report on time to his probation officer, failed to make timely payments on his fines and costs, failed to complete counseling services and failed to undergo outpatient or inpatient treatment.He now faces trial on a charge of driving under the influence (DUI) of alcohol as filed by Rush Township Patrolman Brian Thompson. He was placed in the program January 20, 2011,Kevin A. Kogolis, Shenandoah, was terminated from the program for failure to make timely reports to his probation officer. He now faces trail a on a DUI charge brought by West Mahanoy Township Patrolman Raymond Tonkinson. He was placed in the program Feb. 17, 2011.Joshua Wayne Yeagley, 20, Pine Grove, was terminated from the program for failing to make timely reports to his probation officer, failed to obtain permission to change his address, possessed illegal drugs and failed to perform community service.He faces trial on a charge of retail theft from Walmart Store, Saint Clair. Yeagley was placed in the program Jan. 20, 2011.Heather T. Rutledge, Mahanoy City, was terminated from the program for failing to report a new arrest by Mount Carmel Township police last October on a charge of criminal conspiracy and theft of storm grates from various streets.She now faces trial on a DUI charge filed b West Mahanoy Patrolman Lance J. Monaghan. She was placed in the program June 23, 2011.Adam D. Wilhelm, 28, Pine Grove, was terminated from the program for failing to report regularly to his probation officer, failed to report a new arrest, possessed illegal drugs and failed to provide a screening test.He now faces trial on charges of criminal conspiracy with two accomplices in theft from motor vehicles in Pottsville. Wilhelm was placed in the program Feb. 17, 2011.
