Two Lehighton men accused of burglarizing a restaurant in the borough opted not to have hearings on the charges this week.

Jesse Lee Hackman and Gage Duch, both 18 and both of Gypsy Hill Gardens Apartments, Lehighton, had been arrested and charged with burglarizing the Lehighton Boulevard Restaurant, Route 443, on Sept. 20.They had hearings scheduled Wednesday before District Judge Edward M. Lewis of Jim Thorpe. Both waived the charges to Carbon County Court. They are both presently free on $5,000 bail. The burglary occurred at about 3:58 a.m. on Sept. 20 at the Lehighton Boulevard Restaurant. Video surveillance allegedly captured both defendants leaving the premises at 4:06 a.m.The arresting officer in the case is Detective Michael Svetik of the Lehighton Police Department. The affidavit filed by Svetik indicates entry was gained through a rear window. Taken during the burglary was $475 in cash. The video camera shows that entry was first attempted at an office window, but the actors were unsuccessful.Once inside the restaurant, the actors allegedly kicked in an office door to reach that area of the business. After viewing the video, the owner of the business told police that one of the actors appeared to be a past employee, who was Hackman. He told police Hackman "would of had knowledge of where the money was kept and the familiarization of the building," Svetik writes. The apprehension of Hackman and Duch occurred on Sept. 26 when Office Matthew Bender observed "suspicious persons" in the vicinity of the Dollar General Store at 3:22 a.m. Officer Derek Solt responded and, the affidavit claims, found a pry tool on Hackman.Svetik and Officer Neal Ebbert questioned the two later in the day, and Hackman allegedly admitted that he and Duch committed the Boulevard Restaurant burglary, according to the police report.
