A Carbon County resident admitted to two driving under the influence (DUI) charges, both occurring within a short period of time on the same day, while another man was sentenced to jail on an assault charge.

The two were among several defendants who entered guilty pleas Tuesday in Carbon County court before Judge Steven R. Serfass.Banks incidentMichael A. Hauser, 41, of Junedale, Banks Township, pleaded guilty to the two DUI charges with both occurring on Sept. 22, 2010, near his home in the Tresckow area of the township. He also pleaded to driving while under suspension-DUI related.State police at Hazleton responded to the area of Main and Maple streets, for a report of a truck leaving the road and striking a tree and road sign. The driver of the truck, according to witnesses, then fled the scene.Troopers later stopped Hauser driving near his residence. He was cited for DUI for the crash and for the stop later. A test revealed he had a .14 BAC.On the first DUI charge Serfass sentenced Hauser to serve 30 days to six months in jail, a fine of $750 and a one year license suspension. On the second DUI count he was sentenced to serve 30 days to six months in jail, a fine of $750 and another one year suspension.On the driving under suspension charge he was sentenced to serve 90 days in jail, a fine of $1,000 and another year suspension. The two DUI charges run concurrent but consecutive to the suspension for a total jail term of 120 days to six months. He was also ordered to get a drug and alcohol (D&A) evaluation and follow any recommendation for treatment. Hauser begins the jail term on March 4 at 9 a.m. and was granted work release privileges.NesquehoningincidentMike Barry Messinger, 21, of Nesquehoning, pleaded to one count each of simple assault and disorderly conduct for an incident on June 11, 2010, along S. Radcliff St., in Nesquehoning.Police responded to the area to a report of a fight. Upon arrival officers found that Messinger had struck Brad Yuricheck during a dispute. Yuricheck suffered a fractured jaw in the incident.Serfass sentenced Messinger to serve six to 12 months in jail followed by one year of probation. He was also ordered to make restitution for medical bills of $1,451 to the victim, have no contact with the victim, and get both a mental health and D&A evaluations. On the conduct charge he was fined $300 and costs.Messinger was given credit for 109 days spent in jail on the charges.Other pleasOther defendants in pending criminal cases who entered guilty pleas before Serfass included:Travis A. Walck, 20, of Summit Hill, pleaded to one count each of theft and criminal mischief. He was arrested on Oct. 7, 2009, by Lansford police for taking items belonging to Jeanette Hadesty.Walck told Serfass he had a drug addiction problem but completed a six months inpatient program with the Salvation Army.Serfass placed him on probation for two years and ordered he make restitution of $4,000 to the victim, render 50 hours of community service, and get a D&A evaluation. On the mischief count he was fined $300 and costs.Lea R. Palladino, 40, of Weatherly, pleaded to one count of possession of drug paraphernalia and a motor vehicle code violation. She was arrested on Nov. 28, 2010, along E. Main St., in Weatherly, following a traffic stop.Serfass placed her on probation for a year and ordered zero tolerance on D&A use and render 25 hours of community service. On the summary charge she was fined $25 and costs.Vincent Graham, 23, of Hazleton, pleaded to one count each of DUI and possession of a controlled substance. He was arrested on Nov. 27, 2010, along Broad St., in Beaver Meadows. Found on him was marijuana. Given a test, the result showed the presence of a controlled substance.On the DUI charge Serfass sentenced him to serve 72 hours to six months in jail, a fine of $1,000, license suspended for a year, and get a D&A evaluation. On the possession count he was placed on probation for a year, concurrent with the DUI charge. He was given credit for one day spent in jail on the charge and will begin his jail term on March 4 at 9 a.m.Kermit Sponheimer, 58, of Nesquehoning, pleaded to one count of retail theft. He was arrested on Oct. 1, 2010, at Redner's Warehouse Market in Nesquehoning for taking items valued at $7.78.Because of a prior record, Serfass sentenced Sponheimer to serve six to one day less 24 months in prison and render three hours of community service per month when paroled. He was given credit for 145 days spent in jail on the charge.Richard Lowell Lehr Jr., 41, of New Ringgold, pleaded to one count of DUI. He was arrested on Oct. 20, 2009, along Ludlow St., in Summit Hill. He refused a blood test and will lose his license for a year for the refusal.Serfass deferred sentencing to a later date.Jeffrey Lee Vandegejuchte, 30, of Albrightsville, pleaded in two pending cases against him. He pleaded to one count each of criminal conspiracy-receiving stolen property and false identification to law enforcement officers for an incident on June 6, 2010, in Kidder Township. He was stopped by township police operating a reported stolen vehicle of Daniel McKeon. At the stop he gave a false name.In the second case he pleaded to one count of access device fraud for illegally using the credit card of William Mahmde, also in Kidder Township. He entered Mahmde's vehicle and removed the card.On the conspiracy count Serfass sentenced him to serve one day less 12 to one day less 24 months in prison and two years probation on the false ID count. On access device fraud he was sentenced to the same jail time, running concurrently followed by two years probation.He was given credit for 260 days spent in jail on the charges.Robert B. Mehmeti, 30, of Lansford, pleaded to one count each of DUI, identity theft and false ID. He was stopped on March 6, 2009, along Ridge St., in Lansford. A test revealed a controlled substance in his system. At the stop he gave a false name.On the DUI charge he was sentenced to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension and get a D&A evaluation. On the ID theft charge he was sentenced to serve six to 12 months in jail followed by two years probation and consecutive to the DUI charge. On the false ID he was placed on probation for a year, concurrent to the other charges.He was also fined $500 and costs on a summary offense of driving under suspension.Steven John Orso, 45, of Reading, pleaded to one count of theft. He was arrested by state police at Fern Ridge for theft incidents at the Mount Laurel Golf Club where he was then employed as the manager.Serfass placed him on probation for 36 months and ordered he make restitution to the club of $18,850 and get a D&A evaluation.Daniel James Sabol, 30, of Lansford, pleaded to one count of simple assault on his wife, Judith Sabol. The incident occurred on Dec. 17, 2009, at their residence then in Summit Hill.Serfass placed him on probation for two years.Jaden Diacheysn, 23, of Nesquehoning, pleaded guilty in three pending cases.He pleaded to one count of possession of marijuana for an incident on May 28, 2010, at his residence; one count of unauthorized use of an automobile for an incident on June 3, 2010, in Summit Hill when he took the car of his mother, Joan Diacheysn, without permission; and a count of defiant trespass for an incident on Sept. 7, 2010, at the Lansford Townhouses.On the possession count he was sentenced to time served (30 days) to one year in jail with credit for 32 days; on the unauthorized use count, one year probation concurrent to the possession charge and one year probation on the trespass count, consecutive to the other counts. He has spent a total of 108 days in jail to date on the various counts and on a probation violation.Brian P. Marcotte, 28, of Phillipsburg, N.J., pleaded to one count of DUI. He was arrested on Aug. 20, 2010, along the turnpike in Kidder Township. Give a test, the result was .17 BAC.Serfass deferred sentencing to a later date.Each defendant must also pay court costs and a $50 per month supervision fee while on probation or parole.
