Former Berks man fined $600 after passing stopped school bus

A Berks County man who narrowly avoided hitting children boarding a Tamaqua Area School District bus last year will have to pay $600 in fines.

Schuylkill County Judge James P. Goodman on May 18 accepted 38-year-old Joseph Moriba's plea of guilty to meeting/overtaking a school bus and following too closely, fined him and ordered him to pay $300 fines for each charge, plus court costs and fees.Three counts of recklessly endangering another person, and reckless driving were dropped in the plea deal.According to a criminal complaint filed by West Penn Township police Chief Brian Johnson with District Judge James Ferrier of Orwigsburg, here's what happened:In the early morning hours of March 19, 2015, Joseph Moriba, of Reading, left his job at a group home. Traveling on Route 309, he turned onto Route 443, right behind a Kistler Transportation Company school bus driven by Cindy Rascavage.It was about 6:30 a.m., and Rascavage had stopped the bus, turned on the blinking yellow, then red, lights, and opened the door.She was waiting for three students, ages 19, 14 and 12, to board when Moriba, police say, passed on the right, driving his black Toyota between the children and the bus."Cindy said she doesn't know how the car missed the three kids due to the fact (that) it was dark outside," Johnson wrote in the complaint filed with District Judge James Ferrier of Orwigsburg.Since the incident Moriba has moved to Utah.
