Woman charged with shooting gun, yelling for people to stop fireworks

A Schuylkill County woman has been charged after she shot her gun at people setting off fireworks.

According to the affidavit of probable cause filed by patrolman James Patterson of the McAdoo Police Department:

At 9:53 p.m. July 3, Patterson was dispatched to a home on South Cleveland Street and spoke with the caller who stated he witnessed Colette Miller, 49, of McAdoo, shooting a firearm off in her backyard. He requested assistance from Kline Township Police Department. Officer Justin Farley was dispatched.

Miller was in her backyard on Cleveland Street, which was gated.

Police saw Miller holding a 12-gauge shotgun, and told her several times to put the gun down and step outside the gate with her hands up.

She refused and moved back and forth with the shotgun, pointing it toward the officers at one point.

The officers then drew their firearms at Miller and continued to give commands to drop the weapon and come out with her hands up.

Miller eventually put down the shotgun and attempted to go into her house through the back door.

Patterson stopped Miller, who struggled to get into the house.

During the struggle, Patterson dropped his gun and Miller and he fell to the ground. Miller’s dog, a white boxer, bit him in the thigh.

Farley attempted to get the dog off Patterson and was bitten as well.

Farley was eventually able to control the dog and Patterson was able to detain Miller in handcuffs.

Patterson then attempted to walk Miller from her backyard to the patrol car, but she continued to struggle.

Patterson attempted to maintain control, and in the struggle, he and Miller fell to the ground, but Patterson was able to gain control and secured Miller in the patrol car.

Shortly after, Rush Township police Chief Kenneth Zipovsky arrived on scene, along with Ryan Township police Chief Richard Sinton.

Farley and Zipovsky performed a sweep of the residence and recovered a 20-gauge shotgun, a 9 mm handgun and a .38 handgun.

While recovering the weapons, Farley was bitten on the right arm by the white Boxer dog.

Farley went to Lehigh Valley for further treatment.

Miller faces charges of aggravated assault; recklessly endangering another person; resist arrest/other law enforcement; and disorderly conduct/engage in fighting.

She is free on $25,000 unsecured bail, and scheduled to have a preliminary hearing July 21 before District Judge Stephen J. Bayer of Tamaqua.
