Carbon County court — DUI
Two defendants in driving under the influence cases, who previously pleaded guilty to the charges, were sentenced to a year in jail each on Tuesday afternoon in Carbon County court.
President Judge Roger N. Nanovic II imposed the sentences.
Jim Thorpe arrest
Trevor G. Sommerfield,
38, of Jim Thorpe, was sentenced to serve one to five years in jail on a DUI count, his fourth offense.
He was arrested on April 1, 2018, by Jim Thorpe police for DUI of alcohol. He was originally charged with eight counts, including six summary motor vehicle code violations. Those charges were dropped in a plea deal with the district attorney’s office.
Sommerfield addressed his alcohol problem by successfully completing an inpatient program run by the Salvation Army for six months. He also spent another six months in a program run by the Salvation Army but was not one of total confinement.
On a charge of driving under suspension - DUI related, he was sentenced to serve 90 days in jail and pay a fine of $1,000. On the DUI count he must pay a fine of $2,500 and a one-year license suspension.
The jail terms run concurrently.
Nanovic gave him credit for six months in the Salvation Army program. He will begin serving the remaining six months on June 30 at 9 a.m. and serve it on 91 consecutive weekends.
Lehighton arrest
Samantha Wagenhurst,
37, of Tamaqua, was sentenced to serve one to seven years in prison. She was arrested on July 19, 2019, by Lehighton police for DUI of a controlled substance.
At the time of her arrest she was serving a three-month to five-year term on another DUI conviction. She has a pending parole violation on that charge due to the Lehighton arrest. She is currently an inmate in the county prison.
Nanovic also ordered her to pay a fine of $2,500, have her license suspended for 18 months and supply a DNA sample. She was given credit for 111 days spent in jail on the charge.
On a charge of driving under suspension-DUI related, she was sentenced to serve 90 days in jail and pay a fine of $1,000. The jail terms run concurrently.
She was granted work-release privileges.
Guilty plea
Joshua Beury,
38, of Nesquehoning, pleaded to one count of DUI. He was arrested on Nov. 24, 2019, by Nesquehoning, while riding a bicycle in the borough at about 9 p.m. police stopped him because he had no light on the bike. He was found to be under the influence. He refused to submit to a test.
Beury was originally scheduled to be sentenced on charges of possession with intent to deliver a controlled substance and criminal use of a communication facility.
However, that sentencing was deferred until he gets a drug and alcohol evaluation for the DUI charge. Both cases will then be scheduled for sentencing.
Sommerfield and Wagenhurst both must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole.
