Carbon County court — DUI
Three people who previously pleaded guilty to driving under the influence charges were sentenced on Tuesday afternoon in Carbon County court.
President Judge Roger N. Nanovic II imposed sentences on the following:
Joseph E. Earley,
29, of Coaldale, was sentenced on two counts of DUI.
He was arrested on Jan. 28 and March 11, 2019, both by Lansford police for DUI of a controlled substance.
On the first count he was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000 and one-year license suspension. He was given credit for 25 days spent in an inpatient rehabilitation program and paroled.
On the second count he was sentenced to serve 30 days in prison followed by 59 months in the county’s restrictive probation program (formerly the Intermediate Punishment Program), with the first 60 days on electronic monitoring, ordered to pay a fine of $1,500 and license suspended for 18 months. He was given credit for 25 days. The prison terms run concurrently. He must also supply a DNA sample.
The five days he has remaining on his prison term will be served beginning June 12 at 6 p.m., two days; June 19, two days; and June 26, one day.
Joshua Thack,
23, of Lehighton, was sentenced on two DUI counts.
He was arrested on March 19, 2019, by state police at Lehighton and on May 27, 2019, by Franklin Township police. In both cases he was charged with DUI of a controlled substance.
On the first count he was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000 and one-year license suspension. On the second count he was sentenced to serve 30 days in jail followed by 59 months in the county’s restrictive probation program with the first 60 days on electronic monitoring, pay a fine of $1,500 and license suspended for 18 months. The jail terms run concurrently.
He will begin serving the jail term on June 12 at 9 a.m. and serve it on consecutive two-day weekends.
Richard Turnbach,
52, of Kunkletown, was sentenced to serve five days to six months in jail, pay a fine of $300 and one-year license suspension.
He arrested on Aug. 18, 2018, by state police at Lehighton for DUI of alcohol.
He will begin the jail term at 7 p.m. on June 19 and serve three days, then June 26, two days.
Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee.
