Carbon County court — drug cases

A total of 10 defendants in drug-related cases entered guilty pleas in Carbon County court on Thursday.

Judge Steven R. Serfass accepted pleas from the following:

David Richard Merwarth,

26, of Lansford, pleaded to one count of possession of drug paraphernalia. He was arrested on Oct. 17, 2018, by Lansford police along West Bertsch Street.

He was placed on probation for a year and ordered to get a drug and alcohol evaluation and follow any recommendation for treatment and render 50 hours of community service.

Felix Ramon Munoz,

31, of Fort Collins, Colorado, pleaded to one count of possession of drug paraphernalia. He was arrested on March 27, 2019, by state police at Fern Ridge following a traffic stop along Interstate 80. In exchange for the plea, a charge of driving under the influence was dropped.

Serfass imposed a fine of $500.

Jermaine Gonzalez,

27, of Jim Thorpe, pleaded to one count of possession of a controlled substance for an incident on Oct. 29, 2019, in Jim Thorpe. While being taken into custody in another matter, police found heroin on his person. He also pleaded to one count of theft for an incident on Sept. 3, 2019, filed by Jim Thorpe police. He took a check of a female borough resident and used it at a local business. A forgery charge was dropped in a plea deal.

On the theft count he was sentenced to time-served (43 days) to one day less 24 months in prison, and on the drug count, one year probation, consecutive to the theft charge. He was also ordered to supply a DNA sample, make restitution of $200, get a drug and alcohol evaluation, zero tolerance for drug or alcohol use and render a total of 150 hours of community service.

Joshua James Troxell,

38, of Lehighton, pleaded to one count each of possession of a controlled substance and possession of drug paraphernalia. He was arrested on Aug. 16, 2019, by Lehighton police along Main Lane. A DUI charge was dropped in a plea deal.

He was placed on probation for a year on each count, with the terms running concurrently, and ordered to get a drug and alcohol evaluation and render 50 hours of community service.

Marlana L. Stevens,

30, of Lehighton, pleaded to one count of possession of drug paraphernalia. She was arrested on Aug. 30, 2019, by Lehighton police following a vehicle stop along Route 443. She was a front seat passenger in the vehicle.

Serfass sentenced her to time-served (12 days) to one year in jail, and ordered her to get a drug and alcohol evaluation and render 50 hours of community service.

Ryan A. Cain,

51, of Lansford, pleaded to one count each of possession of drug paraphernalia and possession of marijuana. He was arrested on March 12, 2018, by Lehighton police near the Weissport bridge.

Serfass placed him on probation for a year and ordered he get a drug and alcohol evaluation on the paraphernalia charge and fined $300 on the marijuana count.

Peter Hydro,

51, of Jim Thorpe, pleaded to one count of possession of drug paraphernalia. He was arrested on May 15, 2018, by Jim Thorpe police who responded to a area along Lehigh Street for an unconscious person. He also pleaded to one count of defiant criminal trespass for an incident on July 1, 2018. He entered a garage in the area of School Street owned by a relative, after previously being told to stay out.

Serfass placed him on probation for a year on each count, with the terms running consecutively, and ordered him to get a drug and alcohol evaluation, zero tolerance for drug or alcohol use and render a total of 100 hours of community service.

Joseph T. Igielski,

44, of Philadelphia, pleaded to one count of possession of marijuana. He was arrested on Jan. 25, 2017, by Jim Thorpe police following a traffic stop.

Serfass imposed a fine of $300.

Dianna Atherholt,

40, of Albrightsville, pleaded to one count of possession of a small amount of marijuana. A charge of possession of a controlled substance was dropped in a plea deal. She was arrested on March 21, 2019, by state police at Fern Ridge along Stony Mountain Road in Penn Forest Township, where police served a search warrant looking for another suspect.

Serfass imposed a fine of $300.

Chastity Ann Yatsko,

28, of Tamaqua, pleaded to one count of possession of drug paraphernalia. She was arrested on April 12, 2017, by Lehighton in the area of South First Street, where police responded to a report of a suspicious vehicle. Yatsko was a front seat passenger in the vehicle.

Serfass placed her on probation for a year and ordered her to get a drug and alcohol evaluation and render 50 hours of community service.

Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee.
