CARBON COUNTY COURT - sentencings
Carbon County Judge Steven R. Serfass sentenced the following defendants who pleaded guilty in drug-related cases:
Evan Steven Darling, 25, of Albrightsville, pleaded to one count of possession of drug paraphernalia. In exchange for the plea, a charge of possession of a controlled substance was dropped.He was arrested by state police at Fern Ridge on May 1, 2013, in the area of 189 Mountain Road in Penn Forest Township. He was previously placed in the county's Accelerated Rehabilitation Disposition probation program but was revoked for violating conditions.Serfass placed him on probation for a year and ordered he get a D&A evaluation and render 50 hours of community service.William Joseph Dougherty, 30, of Jim Thorpe, pleaded to two counts of possession of drug paraphernalia with a charge of possession of a controlled substance dropped in a plea bargain.He was arrested on Nov. 18, 2013, in the area of 285 W. Broadway by Jim Thorpe police. Police responded to the area after receiving a call from a citizen concerning drug activity in the area. Doughtery as found in a vehicle and found to have illegal drugs. He was previously placed in the ARD program but was revoked for violating conditions.Serfass placed him on probation for a year on each count, running concurrently, and ordered him to get a D&A evaluation, zero tolerance for D&A use, and render a total of 100 hours of community service.Joshua Jason Miccicke, 20, of Jim Thorpe, pleaded to one count of possession of drug paraphernalia. He was arrested on Jan. 4 at the One Stop Exxon by Kidder Township police who responded to the area for a report of an altercation between two males.On a charge of driving under the influence he was placed in the ARD program. The DUI arrest occurred on May 23 along Route 248 in Franklin Township by state police at Lehighton. A test showed 0.09 BAC.Serfass placed him on probation for a year on the possession count. On the DUI charge he was placed in the ARD program for a year, consecutive to the drug charge and ordered to render 50 hours of community service, pay $450 for the cost of the program and his license was suspended for 90 days.Each defendant sentenced must also pay court costs of about $1,000, and a $50 per month supervision fee while on probation or parole.
