Carbon County court — DUI

Defendants in pending driving under the influence cases entered guilty pleas in Carbon County court on Thursday while others, who previously pleaded to DUI counts, were sentenced by Judge Steven R. Serfass.

Those appearing include:

Christopher H. Wright,

42, of Lake Ariel, Wayne County, was arrested on Nov. 9, 2017, by state police at Fern Ridge for DUI of alcohol. He also pleaded to driving under suspension, DUI related.

On the DUI count Serfass sentenced him to serve 10 days to 24 months in prison, pay a fine of $500, one-year license suspension and render a total of 100 hours of community service when paroled. On the suspension count he was sentenced to serve 90 days in jail and pay a fine of $500.

Wright is currently an inmate in the Pike County prison serving an 11½ to 23-month sentence on other charges which began on Jan. 3. Serfass ruled his sentence would run concurrent with Pike County.

Kyle Christopher Baumann,

25, of Slatington, was arrested on Aug. 24, 2019, by state police at Lehighton for DUI of a controlled substance.

He was sentenced to serve 48 hours to six months in jail, pay a fine of $500, one-year license suspension and render 25 hours of community service.

He will begin serving his prison term at 5 p.m. on July 22.

Bruce Walters,

50, of Woodbridge, Virginia, was arrested on June 13, 2019, by state police at Lehighton for DUI of alcohol.

He was sentenced to serve five days to six months in jail, pay a fine of $300 and one-year license suspension.

He began the jail term immediately.

Andrew Aull-Lawton Kottke,

38, of Sunbury, Northumberland County, pleaded in two pending cases. He was arrested on April 10, 2016, by Weatherly police for DUI of a controlled substance. He was arrested on Dec. 24, 2016, by Weatherly police when he was found passed out behind the wheel of his car. In that case a DUI charge was dropped and he pleaded to possession of drug paraphernalia.

Sentencing was deferred in both cases so Kottke can obtain a drug and alcohol evaluation.

Alexander K. Bachora,

38, of Albrightsville, was arrested on Nov. 16, 2019, by state police at Fern Ridge for DUI of alcohol.

A first offense for sentencing purposes, he was placed on probation for six months and ordered to pay a fine of $300 and render 25 hours of community service.

Joseph Sarti,

20, of Duryea, Luzerne County, was arrested on Sept. 14, 2019, by state police at Fern Ridge for DUI of a controlled substance. He also pleaded to possession of a small amount of marijuana.

Sentencing was deferred so Sarti can obtain a drug and alcohol evaluation.

Joseph Robert Premecz,

36, of Allentown, was arrested on July 2, 2016, by state police of Lehighton for DUI of a controlled substance. He also pleaded to possession of a small amount of marijuana.

On the DUI he was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000, one-year license suspension and render 25 hours of community service. On the drug count he was fined $300.

He was given credit for four days spent in jail on the charges and paroled.

Mia Desiree Leyba,

38, of Albrightsville, pleaded to a summary offense of restrictions on alcoholic beverages with a DUI count dropped. She was arrested on March 31, 2018, by state police at Fern Ridge.

She was fined $25 and costs.

Sentencings

The following defendants were sentenced after previously entering guilty pleas.

James Albert Apgar,

27, of Kunkletown, was placed in the county’s restrictive probation program (formerly the intermediate punishment program) for 90 days on electronic monitoring and ordered to pay a fine of $1,000.

On a DUI count he was placed on probation for six months, consecutive to the first count, and ordered to pay a fine of $300 and render 25 hours of community service.

Patrick Riley Rusden,

22, of Philadelphia, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000, one-year license suspension and render 25 hours of community service. He was given credit for 16 days spent in an inpatient rehabilitation program and paroled.

He was arrested on Aug. 24, 2018, by Lehighton police along the Sgt. Stanley Hoffman Boulevard. A test revealed the presence of a controlled substance.

Jason Eliot Gaudreau,

38, of Jim Thorpe, was sentenced for DUI and resisting arrest.

On the DUI count he was sentenced to serve 30 days in jail followed by 60 days on restrictive probation with electronic monitoring and then 57 months on regular probation, pay a fine of $1,500, license suspended for a year, supply a DNA sample and render a total of 200 hours of community service. On the resisting count he was placed on probation for 24 months, concurrent with the DUI charge.

He was arrested on Aug. 30, 2018, along Lehigh Avenue by Jim Thorpe police. A test revealed the presence of a controlled substance.

He will begin the jail term at noon on July 17 and serve it on consecutive two-day weekends.

Each defendant sentenced must also pay court costs of about $1,000, a $50 per month supervision fee while on parole/probation and follow any recommendation of their drug and alcohol evaluation.
