Renters of a vacation home filed a civil suit against a McAdoo couple named as owners of the properthy for injuries allegedly suffered when a deck attached to the home collapsed.The suit was started by Christine Lubicky, 4009 Creston Street, and Catherine Fox, 4604 Ashville Street, both of Philadelphia; and Wilham Paul Capko, 3300 Whitehall Drive, Willow Grove, against John and Renee Sharkey, 69 Spruce St.The complaint states on July 17, 2010, the trio were invitees in the house known as 22 Dillon Way, Albrightsville. They rented the property for one week as a vacation residence. They claim while the trio were standing on a deck attached to the house socializing with other family members the deck, located approximately 10 feet above the ground, collapsed away from the house and struck the ground and the trio were injured. Each seeks damages in excess of $50,000.Forfeiture of cashDistrict Attorney Karen Byrnes Noon has filed a petition to court to seek forfeiture of $2,034 seized by Rush Township police from an individual involved in retail theft at the Walmart store in Hometown.The petition states on April 25, 2011, the township police were called to the store to investigate a retail theft and confronted Ruben Ortiz, one of the males alleged involved in the incident. The petition states Patrolman Adam Sinton found in a bag possessed by Ortiz which contained heroin and the cash. Ortiz was chaged with possession of a controlled substance, receiving stolen property and retail theft.The petition claims Ortiz's whereabouts are unknown as he "jumped bail" and failed to appear at a preliminary hearing last Nov. 4.Noon claims although Ortiz has not yet been convicted of any violation is due to the fact that he cannot currently be located but under the law neither a criminal prosecution or conviction is required for the court to aprove the forfeiture.Property transfersJoshua A. and Laura Lee Gruver to Jay O. and Pauline A.
