Nine enter guilty pleas

Nine persons in pending criminal cases entered guiilty pleas in Carbon County court on Tuesday. The pleas were accepted by Judge Steven R. Serfass.

Nesquehoning assaultDamian L. Eidem, 24, of Lehighton, pleaded to one count each of siimple assault and disorderly conduct, as a summary offense, for an incident in Nesquehoning. Eidem also faces a large restitution bill.Eidem was arrested by borough police for an assault that occurred along R. Ratcliff St. on June 11, 2010. He admitted assaulting Brad Yuricheck.On the asssault count Serfass sentenced Eidem to time served (21 days) to one day less 24 months in jail. He ordered he make restitution totaling $3,302, which is one half to total, plus get both a drug and alcohol (D&A) and mental health evaluations and follow any recommedations for treatment. On the conduct charge he was fined $300 and costs.Eidem was on probation in Northampton County at the time and is facing a probation revocation hearing. Co-defendant in the case, Melissa Gressler, of Lehighton. She has charges pending.Other pleasOther defendants entering pleas included the following:Amanda Messinger, 20, of Lehighton, entered pleas in two pending cases. She pleaded to one count each of simple assault in both cases.She was charged for an incident on June 20, 2010, in Nesquehoning. Borough police charged her with assaulting Bonnie Strohl. The second incident occurred on March 21, 2010, involving Tanya Farber the victim and took placed in Lehighton. In both cases Messinger's mother, Melissa Gressler, is a co-defendant. Charges against her are pending.For the case involving Farber, Serfass sentenced her to time served (28 days) to one day less 24 months in jail and ordered she render three hours of community service per month while on parole. In the case involving Strohl she was placed on probation for 24 months, running concurrent with the first case.George Thomas Anger, 48, of Lehighton, pleaded to one count of criminal conspiracy-theft by deception. He was charged by Nesquehoning police with passing fraudulent money orders at the county prison where he is an inmate on other pending charges. He was arrested on Nov. 1, 2010.Serfass deferred sentencing at the request of defense Atty. Joseph D. Perilli. Perilli told the court the other charges are being resolved and he wanted Anger to appear on all pending charges for sentencing at a later date.Edwin Miguel Batista, 31, of Hackensack, N.J., and also of Hazleton, pleaded to one count of open lewdness. He was arrested by Weatherly police for an incident near the main entrance ot Eurana Park on Dec. 14, 2009. Police said Batista was in his vehicle with a then 17-year-old girl who was performing a sex act on him.Batista failed to appear for a prior court proceeding and was picked up on a warrant in New Jersey about a month ago and brought back to Carbon County. He has been in the county jail since his arrest on the outstanding warrant.Serfass sentenced him to time served (17 days) to one year in jail and ordered he render 36 hours of community service and have no contact with the girl involved in the case.Katelyn McFarland, 19, of Lehighton, pleaded to one count of aggravated assault. She was arrested for an incident that occurred on Dec. 20, 2010, along SR209 in Nesquehoning.She was found in the area under the influence of alcohol and was placed under arrest. Borough police were assisted at the time by Officer Jeffrey Ohl, of Lansford police. While Ohl was placing her in a police cruiser she became combative and caused an injury to Ohl's hand.Assistant District Attorney Michael Greek told the court the injury caused Ohl to be on medical leave for an extensive period of time.Serfass deferred sentencing to a later date.Dale Ann Stevens, 49, of Jim Thorpe, pleaded to one count of receiving stolen property. She was arrested on June 28, 2010, by Nesquehoning police for an incident at Redner's Warehouse Market. Involved was $58.33 worth of merchandise.Serfass deferred sentencing so Stevens could apply for placement in the county's Intermediate Punishment Program (IPP).Jamie Lynn Koch, 33, of Beaver Meadows, pleaded to one count of driving under the influence (DUI). She was arrested on March 10 along SR93 in Nesquehoning after being involved in a one vehicle crash. Given a test, the result was .22BAC.Serfass sentenced her to serve 48 hours to six months in jail, a fine of $500, one year license suspension, and must get a D&A evaluation.She will begin the jail term at 6 p.m. on June 24.Jamie Lynn Schembri, 33, of Lehighton, pleaded to one count each of persistent disorderly conduct, criminal mischief and simple assault. She was arrested on Aug. 13, 2010, at 21 Tallwood Drive, in Kidder Township.Township police repsonded to the scene to a report of a fight in progress involving several people. Upon arrival officers found Schembri involved and placed her under arrest. While being taken into custody she "elbowed" officer Margaret McNamara.On the conduct charge Serfass placed her on probation for a year and ordered she render three hours of community service per month while on probation. On the assault charge she was placed on probation for 24 months concurrent to the first sentence. On the mischief charge, a summary, she was fined $3000 and costs.Melissa Gressler, 38, of Lehighton, pleaded to one count of DUI. She was arrested on Sept. 5, 2010, along Canal St., in Franklin Township, by state police at Lehighton. Given a test, the result was .10BAC.Serfass sentenced her to serve 48 hours to six months in jail, a fine of $500, one year license suspension, get a D&A evaulation and render three hours of community service per month while on parole.Each defendant sentenced must also pay court costs and a $50 per month supervision fee while on probation or parole.
