Tamaqua enacts fireworks ordinance

Tamaqua Borough Council has enacted a fireworks ordinance just in time for the July Fourth holiday. According to solicitor Michael Greek, the ordinance reflects the state law that is already in effect and was already enforceable.

The borough’s ordinance prohibits the use of illegal explosives, including homemade devices, M-80s, M-100s, quarter sticks, cherry bombs and silver salutes. Display fireworks are to be used only by professional pyrotechnicians and must have a permit obtained from the borough to be used.

Consumer fireworks, also called Class C fireworks, that include firecrackers, roman candles, bottle rockets and fireworks containing a maximum of 50 mg of explosive material can only be used by those 18 years of age and over and may not be ignited or discharged on public or private property without the permission from the owner.

It was noted that the borough does not give permission for the use of consumer fireworks on public property. They may also not be used within 150 feet of an occupied structure or while under the influence of alcohol or drugs. The ordinance does not apply to ground and hand-held sparkling devices and toy caps.

Violations of the fireworks ordinance with consumer fireworks can be fined up to $100. Violations of the fireworks ordinance related to display fireworks can be punished with a fine of up to $500.
