Sentences imposed on Tamaqua man, Lansford woman

Sentences were imposed by Judge Charles M. Miller on a Tamaqua man and Lansford woman after both entered guilty pleas to criminal charges Friday in the Schuylkill County Court.

Brian Lee Filer, 43, of 18 Mauch Chunk Street, Tamaqua, on a charge of possession of a controlled substance was placed on probation 12 months, pay $100 to Substance Abuse Education fund, $50 to Criminal Justice Enhancement Account, a $50 monthly fee for each month he will be on probation, make restitution of $113 to the Bethlehem Regional Lab and $50 to the Tamaqua Police Drug Task Force and pay costs of prosecution.Filer also must seek and obtain a drug and alcohol evaluation and comply with any recommended treatment. He was cited by Patrolman Anthony Stanell, Tamaqua police, last October 30 at his residence.Monica Baker, 33, of 200 Ridge Street, Lansford, was sentenced on a charge of criminal conspiracy to serve 21 months to 42 months in a state correctional facility. She received credit for serving 906 days in various prisons. She was ordered to pay $50 to Criminal Justice Enhancement Account, make restitution of $9,000 to Orviel Reed. Coaldale, and $569 to Mauch Chunk Trust Company.On additional charges, criminal trespass, serve 16 months to 32 months in a state facility to run concurrent with the conspiracy sentence and on a charge of defiant trespass received no further penalty.Baker first pleaded guilty to the charges in November 2007 but Judge Miller deferred sentence and sent her to a state prison for evaluation and to determine if she had a drug problem. She was later sentenced to serve 24 months at Muncy under the Immediate Punishment Program. Baker was cited by Patrolman Robert Melloy, Coaldale Police, in December 2006 for trespassing on property at 129 Moser Avenue.Revoke ProbationFor the second time Brian Michael McCollough, 31, of 31 North Vine Street, Tamaqua, had his probation revoked for failing to obey the rules. At a hearing Friday before Judge John E. Domalakes he admitted to possessing heroin when he is not allowed to have drugs.Judge Domalakes revoked his probation and remanded him to the county prison taking away his 73 days of liberty and creating a new maximum date for his release, June 27, 2011. Judge Domalakes said he would consider an application for probation to allow McCollough enter an inpatient facility to combat his drug habit. McCollough asked if he could go to a half-way house but this request was denied.McCollough originally pleaded guilty in November 2008 to theft and possession of drug paraphernalia charges and after serving 57 days in prison was released on probation. He violated the probation last September but again gained his release and was again apprehended.He was cited buy Patrolman Anthony Stanell, Tamaqua Police, in April 2008.Modify BailA hearing was held Friday on the petition of Russell Frank Mauger, 48, of 2597 Chamony Street, Zion Grove R. R. 1, North Union Township. Judge Miller reduced the bail but fixed a stipulation that Mauger must reside at 1344 Harwood Road, Hazleton, and may not relocate without written permission from the district attorney's office. Also he may not have contact with Lori Ann Walter, of 118 Spring Mountain Road, North Union Township, or her family and follow standard bail requirements in the original order.Mauger was cited by Trooper Mark Demko last March 10 with charges of simple assault and harassment. Last Monday Mauger was arraigned before the district attorney and entered a plea of not guilty to the charges and requested trial by jury.
