A Luzerne County man was sentenced to a county prison term on Thursday in Carbon County court after previously pleading guilty to threatening two people with a gun and discharging it at least three times.
Judge Joseph J. Matika sentenced Kevin Alejandro Polanco Perez, 19, of Hazleton to serve nine to one day less 24 months in prison on two counts of aggravated assault and one count of terroristic threats.Perez was arrested on Aug. 21, 2016, by state police at Hazleton for an incident in a wooded area off Route 93 and Spring Mountain Road in Packer Township. Troopers said Perez came to a party being held in the woods and displayed a handgun to two victims.He fired one shot into the air while threatening the two. As the two fled the area, troopers said Perez fired two more shots in their direction.The police report did not indicate why Perez confronted the two victims.Matika told Perez, “You made an extremely poor choice that day which is going to follow you for the rest of your life.”Matika said at only 19, he was 18 when the incident occurred, Perez will have a prior record score that will affect him in seeking employment and also if he is ever arrested again.Perez told Matika, “I made a bad decision. I was wrong. I just want to move on from all this.”In addition to the prison term, Perez was ordered to get both mental health and drug and alcohol evaluations and follow any recommendations for treatment, supply a DNA sample, render 75 hours of community service when released on parole, get his high school or GED diploma, pay court costs of about $1,000, pay a $50 per month supervision fee while on parole and have no contact with the victims.He was given credit for 123 days already spent in prison on the charges.
