Man charged with 3rd retail theft

A Coaldale man has been charged with retail theft for the third time.

According to the affidavit of probable cause filed by Trooper Peter Conforti of the Frackville state police in the case against John Bartenope:

At 2:33 p.m. June 29, Conforti was dispatched to Walmart in Rush Township where a loss prevention officer said they had a woman detained. The man she came with, Bartenope, was seen walking out of the store with a blue and gray Penn State polo shirt which he did not pay for.

The woman said the shirt was worth $15 and the man ripped the tags off in the store.

The woman said they arrived in a gold Nissan Frontier pickup truck.

Police located the truck, which was registered to Bartenope’s girlfriend.

Conforti saw the blue and gray Penn State Polo shirt in the truck.

Bartenope, 43, was taken into custody. He found two waxine baggies stamped “Party rocks with a tuxedo.”

Bartenope faces charges of retail theft and drug possession.

He is free on $25,000 unsecured bail, and scheduled to have a preliminary hearing Sept. 8 before District Judge Stephen J. Bayer of Tamaqua.
