Defendants plead in DUI cases

Seven defendants in pending DUI cases entered guilty pleas before Judge Joseph J. Matika in Carbon County court on Tuesday.

George Michael Dougherty, 23, of Coaldale, was arrested on March 20, 2014, along Ridge Street by Lansford police. A test showed the presence of a controlled substance.Dougherty is currently in inmate in the Schuylkill County prison on a probation violation. Sentencing was deferred so he can obtain a drug and alcohol evaluation after he is released from Schuylkill.James William Riach, 24, of White Haven, was arrested on Aug. 6, 2014, along Route 940 by Kidder Township police. A test showed 0.12 BAC. At the time he was operating an all-terrain vehicle that left the road and landed in a ditch.Sentencing was deferred so he could obtain a comprehensive D&A evaluation.Frederick Willi Puderer, 39, of Mahanoy City, was arrested on July 27, 2014, along Packer Street by Weatherly police. A test showed 0.13 BAC.Sentencing was deferred so he can obtain a D&A evaluation.Joseph Anthony Flammia, 25, of Albrightsville, was arrested on Jan. 14 along Blakeslee Boulevard Drive East by Mahoning Township police. A test showed the presence of a controlled substance.Sentencing was deferred so he could obtain a D&A evaluation.Victor John Svitilla, 32, of Lansford, was arrested on Feb. 5 along Ridge Street by Lansford police. A test showed 0.16 BAC.He was placed on probation for six months, ordered to pay a fine of $300, and render 25 hours of communityservice.Michael Joseph Neff Jr., 21, of Lehighton, was arrested on May 27, 2013, along Main Street in Franklin Township by state police at Lehighton. A test showed the presence of a controlled substance.Sentencing was deferred so hecould obtain a comprehensive D&Aevaluation.Neff was previously placed in the county's Accelerated RehabilitationDisposition probation program for first-time offenders but was revoked from it for violating conditions.Gets breakJames Matthew Setser, 36, of Monroe Township, was arrested on Sept. 24, 2014, along the turnpike in Kidder Township by state police at the Pocono barracks. A test showed the presence of a controlled substance.However, in a plea agreement the DUI charge was dropped and he pleaded to two motor vehicle code summary offenses of failure to use proper traffic signal and not wearing a seat belt.He was fined a total of $35.Each defendant sentenced must also pay court costs of about $1,000, and a $50 per month supervision fee while on probation or parole.
