Justin Hill, 20, of 366 W. Bertsch St., Lansford, faces charges from an incident which took place in that borough at 7:35 a.m. May 5, 2010, on Parkway Street. Charges of driving under the influence, duties at stop signs, and reckless driving were filed by Chief John Turcmanovich. According to an affidavit of probable cause:

Turcmanovich was dispatched to Parkway and West Bertsch Street for a traffic accident. Fire and ambulance crews were also called out.At the scene, he found a 1998 Jeep Wrangler sitting broadside across the street. The Jeep had hit a utility pole, snapping it in half, with the top half blocking the street.The driver, identified as Hill, was out of the Jeep and lying alongside the vehicle, complaining of leg and back injuries and pain. He was being attended to by several people who were passing by at the time.Hill was treated by local EMS and Carbon County paramedics, then taken to St. Luke's Miners Memorial Hospital, Coaldale.PPL arrived, secured the scene from downed wires and removed the top half of the pole from the street. The Jeep was towed by Krajcirik's Towing Service. A witness, Joseph Orsulak, told police he saw the Jeep traveling west in the 300 block of West Bertsch Street at a very high rate of speed. The Jeep failed to stop at the posted stop intersection at Cortright Street, continuing to speed west on Bertsch.As the Jeep was rounding the curve from West Bertsch Street to Parkway, it started to slide sideways until it was broadside on Parkway, and then ran head-on into the pole.Hill was being treated in the emergency department when police arrived at the hospital. He was told of the situation at the accident scene, and where his Jeep was.Due to the allegations against Hill of his erratic driving and the seriousness of the accident, Hill was asked to submit to a blood test for driving under the influence of alcohol and/or drugs.He refused, and police explained that his refusal meant losing his driver's license. He was asked several times, with the consequences explained each time. He continued to refuse.Finally, Hill said he had shot up with heroin the day before and it would still be in his system. This statement was witnessed by the emergency room nurse and noted in her charts.Hill was taken for his medical tests and kept hospitalized for a short period of time.On Aug. 24, 2011, a search warrant was applied for and granted to police to obtain Hill's medical records of treatment and tests that were performed at the hospital on May 5, 2011. The results of the tests showed positive for opiates and benzodiazepines in his blood and urine.
