Man charged in Hazleton shooting that began as Lehighton argument

Police charged a Hazleton man with a shooting that stemmed from a disturbance at a Lehighton nightclub earlier this month.

A second man is expected to turn himself in Wednesday, police said.

Cristian R. Soto-Tejeda, 25, of Lincoln Street, appeared before District Judge James Dixon for arraignment Monday on charges of aggravated assault, three counts; reckless endangerment 16 counts, and firing an weapon inside a building.

Soto-Tejeda, who was also wounded in an exchange of gunfire inside Sazon Latino at 58 N. Wyoming St., Hazleton, was released on $100,000 unsecured bail due to his medical condition and pending surgery.

One of the bullets that struck him lodged near his spine, which is why he was released with electronic monitoring and additional conditions, Dixon said Tuesday.

The judge said Soto-Tejeda was assisted into the courtroom for the arraignment.

Dixon said he would not have given bail, based on the charges and the summary of events in the criminal complaint, if it was not for the serious injuries Soto-Tejeda suffered and his need for continued medical care.

Conditions of bail include refraining from alcohol and drugs, other than those prescribed for treatment, the surrender of any weapons that may have been in his residence, and refraining from contact with victims or witnesses, the judge said.

He is only allowed to leave his residence for medical treatment, to see his attorney and court appearances. His preliminary hearing is scheduled May 1 at 9 a.m.

According to the criminal complaint, Soto-Tejeda exchanged words with Kenduar Puello-Arias after an assault occurred inside a Lehighton club on April 3.

One person was assaulted, police said, but they did not know the nature and cause of the assault. Lehighton police responded to the disturbance at the club, court papers said.

After the assault, Puello-Arias tried to calm down the situation and urged Soto-Tejeda to let it go and to walk away, court papers said.

Witnesses told police Soto-Tejeda felt Puello-Arias was being disrespectful toward him, and a friend urged him to calm down.

Soto-Tejeda left the Lehighton club and went to his residence in Hazleton, where he picked up a Glock 9mm semiautomatic handgun and concealed it under his shirt, court papers said.

A witness told police that he was afraid there would be trouble if Soto-Tejeda went to Sazon Latino, where he knew Puello-Arias had gone. Others from the nightclub also showed up at the Hazleton restaurant about 6:15 a.m., court papers said.

Soto-Tejeda arrived at the restaurant about eight minutes after the others, as captured on video surveillance, police said. He entered the restaurant, crouched down and fired a semiautomatic gun inside restaurant, police said based on the video footage.

Another camera angle shows projectiles striking interior glass, dust, debris, propellant gases and glass in the air, police said.

Officers said the first bullet strikes came from the direction of Soto-Tejeda.

Puello-Arias then returned gunfire, striking Soto-Tejeda twice in the right arm/armpit, police said, and Soto-Tejeda can be seen leaving the restaurant, wincing in pain.

Puello-Arias is seen leaving the restaurant in pursuit, and fired a gun northward on the street outside, police said.

The video shows people running and ducking for cover as gunshots are fired past them by Soto-Tejeda, police said.

Two innocent bystanders were struck by the gunfire, police said. A man who was eating his breakfast was shot twice in the left leg, while a woman was grazed by a bullet, causing bruising, police said. The male bystander was treated and released from the hospital, police said.

Police recovered the gun Soto-Tejeda used from his vehicle in the parking lot of Lehigh Valley Hospital-Hazleton, where he was taken by another man who had picked him up earlier at his residence.

Puello-Arias was not injured, and surrendered his gun to police. He is expected to turn himself in to police Wednesday, Hazleton Police Chief Brian Schoonmaker said Tuesday afternoon.
