NY man charged after high-speed chase

A New York man has been charged after leading police on a high-speed chase in which speeds reached 130 mph.

According to the affidavit of probable cause filed by Trooper James Scott of the State Police at Hazleton barracks in the case against Christopher Diaz:

At 3:14 a.m. Feb. 13, Scott was dispatched to assist Hazleton City Police Department with an active pursuit involving a white Mercedes-Benz traveling north on Route 309 in Hazleton.

While en route, Scott was advised that the vehicle passed Airport Road, continued traveling north on 309, subsequently turning onto Interstate 80 eastbound.

It was called out by Hazleton City Police the vehicle exited off the interstate at Exit 273 (White Haven) and continued north on Route 940.

Scott then exited off at the same exit, at which point in time the pursuit was terminated by Hazleton City’s Officer in Charge. Scott then terminated his lights and sirens and continued on Route 940 to travel back onto I-80 westbound.

Scott was then contacted that the vehicle involving the pursuit possibly disabled a White Haven Police Department patrol vehicle, as it was reported the vehicle fled onto I-80 traveling eastbound at mile marker 273.

Scott then traveled back onto I-80 eastbound and parked at the turn around located at mile maker 277.4, at which time a white Mercedes-Benz passed by him traveling in the left lane of travel at a high rate of speed.

Scott activated his emergency lights and sirens and went after the vehicle, which failed to stop and continued traveling eastbound at speeds over 120 mph.

The vehicle continued traveling at a high rate of speed in excess of over 130 mph for about seven miles, before taking Exit 284 (Blakeslee).

Upon exiting the interstate, the pursuit continued on several streets throughout Kidder Township before the vehicle then lost control on a curve, traveling into an embankment on the right shoulder of the roadway of Lake Harmony Road and Lapuma Drive.

As Scott exited his vehicle, he observed Diaz, 33, attempt to accelerate out of the embankment, which was unsuccessful. Scott observed one occupant in the passenger seat who was later identified as Justin Sandoval, and an additional occupant in the second row, right side, who was later identified as Jonathan Perez.

A felony stop was then conducted where all occupants were removed from the vehicle and placed into custody. While removing Diaz, a strong odor of burned marijuana was observed emanating from him, along with glossy blood shot eyes.

Scott transported Diaz from the scene to Lehigh Valley Hospital-Hazleton, to be evaluated by medical staff where he was eventually cleared by a doctor.

Diaz faces charges of fleeing or attempting to elude officer; driving under influence of alcohol/controlled substance; recklessly endangering another person; exceed maximum speed limit established by 65 mph; driving at safe speed; disregard traffic lane; fraudulent use/removal of registration plate; driving without a license; careless driving; and reckless driving.

Diaz is incarcerated in the Carbon County Correctional Facility in lieu of $75,000 cash bail, and scheduled to have a preliminary hearing Wednesday before District Judge Joseph D. Homanko Sr. of Weatherly.
