Carbon County court — drug cases

A Carbon County man was given a county prison term on Monday after pleading guilty to a charge of terroristic threats.

He was one of 10 defendants in pending criminal cases to enter a guilty plea before Judge Joseph J. Matika.

Weatherly incident

Thomas W. Eichelberger

, 59, was sentenced to serve six to 12 months in the county prison on the charge.

Eichelberger was arrested on June 17, 2017, by Weatherly police.

Eichelberger admitted to mental health issues and also a problem with drugs and alcohol. He had left the area after the incident and was found in Maryland and was extradited back to Carbon County.

Matika also ordered him to get both drug and alcohol and mental health evaluations and follow any recommendations for treatment, zero tolerance for drug and alcohol use, supply a DNA sample and render 50 hours of community service.

He was given credit for 71 days spent in prison on the charge.

Other pleas

Cory James Maconeghy

, 29, of Avoca, Luzerne County, pleaded to two counts of criminal conspiracy — retail theft. He was charged for incidents on Feb. 24, 2016, at the Walmart Store and Aldi’s Market, both in Mahoning Township.

He was previously placed in the county’s Accelerated Rehabilitation Disposition probation program but was revoked for not paying court costs.

Matika placed him on probation for 18 months on each count, with the terms running concurrently. He also ordered him to pay total restitution of $131.75, which is a half share since there is a co-defendant in the case, render 75 hours of community service and stay out of both stores.

Michael Daniel Smith

, 26, of Palmerton, pleaded to one count of retail theft. He was arrested on April 23, 2017, by Mahoning Township police for an incident at the Walmart store.

He was placed on probation for a year and ordered to render 50 hours of community service and stay out of the store. There was no restitution as the stolen items were recovered.

Sara Ann Mertz

, 41, of Lansford, pleaded to one count of tampering with evidence.

She was arrested on March 29, 2017, by Lansford police for her part in the theft of a four wheeler all-terrain vehicle from the impound lot of Krajcirik’s Automotive at 343 W. Patterson St. Shawn Ketchledge is a co-defendant in the case and previously pleaded guilty to his part in the incident and was placed on probation.

Matika placed Mertz on probation for a year and ordered her to render 50 hours of community service, make restitution of $675, her share of the total, and stay off the property.

Wendy Kaminitsky

, 40, of Lansford, pleaded to one count of persistent disorderly conduct. A charge of criminal trespass was dropped in a plea bargain.

She was charged for an incident on Aug. 27, 2017, in Lansford. She is currently an inmate in the county prison on the charge.

Matika sentenced her to serve three to 12 months in prison and ordered her to get a drug and alcohol evaluation. She was given credit for 106 days already served and paroled.

Kenneth Bollinger

, 28, of Allentown, pleaded to one count each of hindering apprehension and criminal mischief. A charge of possession of an offensive weapon was dropped in a plea bargain.

He was arrested on Nov. 23, 2017, by Nesquehoning police in the 100 block of East Catawissa Street. He was found with a stun gun.

Matika sentenced him to time-served (34 days) to one year in jail on both counts, running concurrently, and ordered restitution of $200.

Bollinger is currently in custody for a state parole violation.

Erick James Rivera

, 26, of Lake Harmony, pleaded to one count of theft. He was charged by Kidder Township police for an incident on Feb. 25, 2017, in which kayaks were stolen.

Matika sentenced him to time-served (90 days) to 18 months in jail and ordered he render 50 hours of community service.

He is currently an inmate in the county prison facing a probation violation charge.

Michael Anthony Iannelli

, 19, of Philadelphia, pleaded to one count of escape. He was charged by state police at Fern Ridge for leaving the Camp Allen youth forestry facility in Kidder Township on Nov. 9, 2017, without permission. He had been placed at the camp by a Philadelphia court.

Matika, noting a prior juvenile criminal record and pending charges for felony robbery, sentenced him to serve three to 18 months in the county prison and ordered he supply a DNA sample, get both drug and alcohol and mental health evaluations and render 75 hours of community service.

He was given credit for 75 days already served on the charge.

Shane Houser

, 20, of Nesquehoning, pleaded to one count each of false reports and unsworn falsification to authorities. He was arrested by Nesquehoning police on Feb. 12, 2017 in the 100 block of Stock Street. There are two co-defendants in the case.

Matika placed him on probation for a year on both counts, running concurrently, and ordered he render 50 hours of community service.

Christine Ann Trotta

, 49, of Palmerton, pleaded to one count of retail theft. She was arrested by Mahoning Township police for an incident at the Walmart store.

Sentencing was deferred.

Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation or parole.
