Carbon County Court — ARD

Eight first-time offenders were placed in Carbon County’s Accelerated Rehabilitation Disposition probation program last Monday by President Judge Steven R. Serfass.

If a person successfully completes all conditions of the program their record will be wiped clean. However, if they fail to complete it or are revoked from it, then they will face trial on all pending charges. A person does not admit guilt in entering the program.

All were placed for a year, unless otherwise noted.

Diane Marie Dellavecchio

, 47, of Kunkletown, was placed for two years on a small amount of marijuana charge. The alleged offense occurred Aug. 31. She was assessed $450 for the cost of the program, given 100 hours of community service, and ordered to pay $129.04 in restitution to James Dellavecchio.

Jared Hunter

, 21, of Lehighton, was placed on a charge of driving under the influence of a controlled substance. The alleged offense occurred on June 27. He was assessed $600 for the cost of the program, given a 60 day driver’s license suspension and 50 hours of community service,

Kyle Mason Knauss

, 22, of Lehighton, was placed on a charge of driving under the influence of a controlled substance stemming from a March 24 incident. He was assessed $600 for the cost of the program, given a 60-day license suspension and 50 hours of community service.

Devon Jeffrey Weiseman

, 24 of Catasauqua, was placed on a charge of driving under the influence of a controlled substance. The alleged offense occurred on Aug. 6. He was assessed for the cost of the program, given a 60-day license suspension and 50 hours of community service.

Jeffrey Butz

, 39, of Lehighton, was placed on a charge of possession of drug paraphernalia. The alleged offense occurred on July 17. He was assessed $450 for the cost of the program, and given 50 hours of community service.

Tyler Anthony Devine-Aber

, 20, of Effort, was placed on a charge of driving under the influence of a controlled substance. The alleged offense occurred on June 16. He was assessed $450 for the cost of the program, given a 90-day license suspension and 50 hours of community service.

Francisco Demitri Rivera

, 24, of Allentown, was placed on a charge of driving under the influence of a controlled substance. The alleged offense occurred on June 18. He was assessed $600 for the cost of the program, given a 60-day license suspension and 50 hours of community service.

Todd Anthony Brown

, 50, of Bensalem, was placed on a driving under the influence charge. He was arrested June 25 by Lehighton Borough Police. He was assessed $650 for the cost of the program, ordered to perform 50 hours of community service, and his license was suspended 30 days.

Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while in the program. Those charged with DUI must receive a drug and alcohol evaluation and follow any recommendations for treatment.
