Tamaqua district court

Four people failed to appear for preliminary hearings in the court of District Judge Stephen Bayer on Aug. 8, and are all subject to now having warrants issued for their arrests.

Jody Danielle Forker, 45, of Tresckow, was due in court to answer to charges of possession of a controlled substance with intent to deliver, possession of a controlled substance and two counts of possession of drug paraphernalia. The charges were filed by Rush Township patrolman Bradley Hess after a May 30 incident.All of the charges were held for county court.Savannah Searfoss, 20, of McAdoo, ditched her hearing on charges of escape and disorderly conduct filed by Kline Township patrolman Frederick Lahovski. The charges stem from a June 24 incident.All of the charges were held for county court.David Michael Burns Jr., 28, of Hazleton, was a no-show for his hearing on charges of obstruction of justice, defiant trespass and public drunkenness. The charges were filed by Kline Township patrolman Joseph David in connection with a June 24 incident.All of the charges were held for county court.Monica Lynn Walck, 29, of Bowmanstown, didn't appear in court to answer to a charge of possession of drug paraphernalia. The charge was filed by Rush Township patrolman Christopher Hamilton after a March 18 incident.The charge was bound over for trial in Schuylkill County Court.Kayla Leibowitz, 28, of Coaldale, had her hearing on charges of drug delivery resulting in death, possession of a controlled substance, possession with intent to deliver and criminal use of a communications facility. The charges were filed by Coaldale Police Chief Keith Krapf after the March death of George Dougherty, who died of acute fentanyl toxicity. Leibowitz admitted selling heroin to Dougherty the night before his death.All of the charges were held for county court.Leibowitz was returned to the Schuylkill County Prison in Pottsville in lieu of $100,000 straight bail.Scott Allen Noll, 42, of Minersville, was in court for his hearing on charges of stalking, witness intimidation, and harassment. The charges were filed by Tamaqua patrolman Karl Harig in connection with a June 16 incident.After hearing testimony, Judge Bayer held all of the charges for county court.John T. Stapleton, 55, of Tamaqua, had one charge of making terroristic threats dismissed, while a second charge was held for court. Coaldale Criminal Investigator Todd Weiss filed the charges after a Feb. 22 incident.Stapleton was released on $10,000 unsecured bail.Defendants who had their charges withdrawn included: Richard Aviles, 29, of Emmaus; and Portia Rae Dyszel, 25, of Mahanoy City.
