Carbon County court - DUI

Seven defendants who previously pleaded guilty to driving under the influence and related charges were sentenced Monday in Carbon County Court.

President Judge Roger N. Nanovic II imposed the following sentences:Terrence Stephen Roberts, 27, of Lehighton, was sentenced to serve 90 days to five years in prison, a fine of $2,500 and license suspended for 18 months.He was arrested on Feb. 18 along Constitution Avenue by Lehighton police. A test showed the presence of a controlled substance.On a charge of driving under suspension - DUI related, he was sentenced to serve 90 days in jail and a fine of $1,000. The jail terms run concurrently.Roberts is serving a state prison term imposed in Northampton County until Jan. 5, 2018. Nanovic ruled his sentence run concurrent to the state prison term.David K. Brown Jr., 47, of Nesquehoning, was sentenced to serve two days in prison followed by 178 days in the county's Intermediate Punishment Program - house arrest. The first 28 days will be on electronic monitoring. He must also pay a fine of $1,500 and one-year license suspension.He will begin the jail term at 5 p.m. on July 28.He was arrested on Nov. 19, 2015, along River Street by Jim Thorpe police after being involved in a rollover crash. A test revealed a 0.12 BAC.Samantha Lynn Kuntz, 28, of Lehighton, was sentenced to serve 60 days in jail on a driving under suspension - DUI related charge and a fine of $500.On a possession of drug paraphernalia charge she was placed on probation for a year, consecutive to the first count. Nanovic also imposed zero tolerance for drug and alcohol use.She was arrested on April 17, 2016, in the 900 block of Delaware Avenue by Palmerton police.She is currently in the county prison serving a sentence for another DUI which ends out on Aug. 19. Nanovic ruled his sentence runs consecutive to that term.Peter Devin Devine, 39, of Effort, was sentenced to serve 5 days to 6 months in jail, a fine of $1,500 and one-year license suspension.He was arrested on Jan. 31, 2016, by state police at Lehighton along Interchange Road in Towamensing Township. A test revealed a 0.17 BAC.He will begin the jail term at 10 a.m. on July 25.Arthur Irvin Cotten,37, of Ephrata, Lancaster County, was sentenced to serve five days to six months in prison, a fine of $750 and license suspended for a year.He was arrested on Oct. 22, 2013 by Lehighton police.He was given credit for 79 days served in prison on the charge and paroled.Lloyd Richard Heckman Jr., 55, of Parryville, was sentenced to serve 72 hours to six months in jail, a fine of $1,000 and one-year license suspension. On a possession of drug paraphernalia charge he was placed on probation for a year, consecutive to the DUI charge.He was arrested on Aug. 18, 2016, along Dairy Road in Lower Towamensing Township by state police at Lehighton. A test revealed the presence of a controlled substance.Heckman will begin his jail term at 6 p.m. on July 21. Heckman said he completed 28 days in an inpatient program but had no documents to prove it. Nanovic gave him 24 hours to produce the proof to the probation office. If he does, he will receive credit for the 28 days and paroled. If not, he must report to the prison as ordered.Christopher J. West,46, of Jim Thorpe, was sentenced to serve 30 days to six months in jail, a fine of $1,500 and one-year license suspension.He was arrested on Nov. 5, 2016, at 315 Center Ave., by Jim Thorpe police after his vehicle collided with a parked vehicle. A test revealed a 0.22 BAC.He will begin the jail term at 9 a.m. on Aug. 8.Each defendant must also pay court costs of about $1,000, a $50 per month supervision fee while on parole and follow any recommendations of their drug and alcohol evaluation.
