Man in cemetery thefts charged in Lehigh Twp. case

Charges have been filed against a Lehighton man who previously pleaded guilty to cemetery thefts in Carbon and Monroe counties.

Edward Mackerley, 33, faces charges on four counts of theft, three counts of receiving stolen property and two counts of burglary.According to an affidavit of probable cause filed by Detective Matthew Enstrom of the Lehigh Township Police Department, a Danielsville resident reported a burglary at his home on May 27, 2015.The resident said someone pried open the front door, went into his garage, took $800 in cash, $1,700 in coins, a hunting rifle, .38-caliber pistol, .22-caliber pistol and a briefcase with paperwork.On June 27, 2015, Mackerley's girlfriend contacted police and said she recovered a briefcase at her home with paperwork that belonged to the victim. She said the victim is her grandfather.The girlfriend referred police to the home of James Keiper in Tobyhanna, where Pocono Mountain Regional Police recovered a DeWalt 18-volt cordless drill, two 18-volt batteries, and a framing saw.The girlfriend found more stolen property at her house and turned it over to Mahoning Township Police. She went through Mackerley's phone and found a picture of a small handgun.Lehigh Township police obtained a search warrant for the shed and recovered an empty plastic jug; an open briefcase; a case with speakers and a pair of handcuffs; coffee can with coin wrappers; handgun box with paperwork; a strong box; a briefcase with paperwork; a bank bag; general construction paperwork; suitcases with assorted clothing; disposable camera; a case with paperwork; and 11 packs of baseball cards.On June 30, police interviewed Mackerley, who denied that he committed the burglary, and blamed another man for it.He said he got the gun shown in the cellphone photo from the same man, and said that he was with Keiper and the other man when they cashed in a large amount of change at stores in Lehighton.Mackerley denied knowing anything about the stolen tools.On July 1, Enstrom interviewed the man Mackerley said committed the burglary, who denied his involvement in the burglary or having the handgun. He said he was with Mackerley when Mackerley cashed in change for $150.On July 9, Enstrom interviewed Keiper, who said one night he was with Mackerley, who parked the car and told Keiper to leave, drive up the road and wait at a park.Keiper returned to the area and picked up Mackerley, who put a large bag and a large jug of change in the trunk. He said they went to a convenience store in Palmerton to cash in the change.Keiper said he got a pack of cigarettes and they bought heroin, and that the stolen tools found at his home were from the last job he worked.On Jan. 9, 2016, Enstrom obtained a court order for cellphone records and spoke to Mahoning Township Police about Mackerley's cellphone containing a picture of the .22-caliber handgun.A polygraph exam and interview was conducted with Keiper on Feb. 3, 2016. Keiper admitted that he was involved in the burglary with Mackerley.On Dec. 30, 2016, Mackerley told police the other man brought the gun to his house. He said that they sold the gun for drugs.Mackerley was arraigned Tuesday before Hawke and sent to Northampton County Prison in lieu of $75,000 bail.He is scheduled to have a preliminary hearing before Hawke at 9 a.m. June 13.Keiper is also facing charges in the incident.Keiper and Mackerley previously pleaded guilty to stealing 17 veterans' markers, a cemetery vase and a plaque from St. John's Union Church Cemetery in Mahoning Township. The theft occurred on Nov. 20, 2015. Mackerly is also charged in other cemetery thefts.
