Carbon County court - DUI

Seven defendants entered guilty pleas Tuesday in Carbon County court to driving under the influence and related counts.

Judge Joseph J. Matika accepted the pleas from the following:Harrison Ellis Shive, 49, of Richboro, Bucks County, was arrested on March 7, 2014, by Kidder Township police at the entrance road to Jack Frost ski area. A test revealed a 0.21 BAC. Shive is currently an inmate in the county prison.Matika sentenced him to serve 9 to 24 months in prison, pay a fine of $500, one year license suspension, zero tolerance for drug and alcohol use and render 75 hours of community service.He was given credit for 70 days spent in jail on the charge.Daniel Joseph Schaub, 35, of McAdoo, was arrested on Aug. 20 along Tamaqua Street by Beaver Meadows police. He pleaded to driving under suspension-DUI related and prohibited acts. He is an inmate in the county prison.Matika sentenced him to serve two to 12 months in prison on the prohibited acts count and 30 to 60 days on the suspension count, with the terms running concurrently.He was also ordered to get a drug and alcohol evaluation and pay a fine of $500 on the suspension count. He was given credit for 60 days already served and paroled.Robert L. Gerhold Jr., 49, of East Stroudsburg, was arrested on Aug. 28, 2010, along Broad Street by Beaver Meadows police. A test revealed the presence of a controlled substance.Sentencing was deferred so Gerhold can obtain a comprehensive drug and alcohol evaluation.Chasity Elizabeth Reed, 22, of Tresckow, was arrested on June 20, 2015, by state police at Hazleton along Tresckow Road in Banks Township. A test revealed the presence of a controlled substance.Sentencing was deferred so she can apply for placement in the Intermediate Punishment Program - house arrest.Harry John Gasker Jr., 33, of Nesquehoning, was arrested on July 13, 2014, along Center Street by Nesquehoning police. A test revealed a 0.16 BAC.He was previously placed in the Accelerated Rehabilitation Disposition probation program but was revoked for violating the conditions.Matika placed him on probation for six months and ordered he pay a fine of $300 and render 25 hours of community service.Amy S. Burns, 35, of Harrisburg, and formerly of Lansford, was arrested on May 16 along Route 443 in Mahoning Township by state police at Lehighton. A test revealed the presence of a controlled substance.Sentencing was deferred so she can obtain a drug and alcohol evaluation.Justine Louise Simon, 41, of Nesquehoning, was arrested on Aug. 26, 2015, along Route 209 by Nesquehoning police. A test revealed the presence of a controlled substance.She was sentenced to serve 72 hours to six months in jail, a fine of $1,000, one-year license suspension, zero tolerance for drug and alcohol use, render 25 hours of community service and continue counseling sessions.On a charge of possession of drug paraphernalia, which she also pleaded to, she was placed on probation for a year, concurrent with the DUI charge.She was given credit for 21 days spent in inpatient rehab and paroled.Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee.
