Defendants sentenced in DUI cases
Five defendants who previously pleaded guilty to driving under the influence and related charges were sentenced on Thursday in Carbon County court.
Judge Joseph J. Matika imposed sentences on the following:Derek James Donald, 26, formerly of Saylorsburg, and currently an inmate in the Lackawanna County prison, was sentenced to serve 90 days to 60 months in the county prison.He was arrested on March 23, 2014, along Route 940 just west of Route 115 in Kidder Township by state police at Fern Ridge. He was originally stopped for traffic violations and found under the influence of alcohol. A test revealed a 0.08 BAC.He was also ordered to continue counseling, render 100 hours of community service when released on parole, and zero tolerance for drug and alcohol use.Donald is serving a prison term for another DUI and has a pending DUI in Monroe County. Matika ruled his sentence run concurrent with Lackawanna County.On a summary motor vehicle code offense, he was fined $75.Lewis J. Labosky, 46, of Lansford, was placed on probation for six months. He was arrested on June 15, 2014, by Mahoning Township police along Blakeslee Boulevard Drive East. A test showed 0.18 BAC.He was also fined $300 and ordered to perform 25 hours of community service.Fernando Guzman, 52, of Bethlehem, was sentenced to serve 30 days in jail followed by 59 months in the Intermediate Punishment Program.He was arrested on Sept. 20, 2014, along Catawissa Street by Nesquehoning police. A test showed 0.27 BAC.He was also ordered to pay a fine of $1,500, have his license suspended for 18 months, render 100 hours of community service, and zero tolerance for D&A use.The first 60 days of the IPP will be spent on electronic monitoring. He was given credit of 39 days spent in a drug inpatient rehabilitation program and was paroled from the jail term.The IPP will be administered by Northampton County adult probation office.Kevin John Gieniec, 30, of Lansford, was sentenced on a DUI charge and driving while under suspension-DUI related.On the DUI charge he was placed on probation for six months and ordered to pay a fine of $300 and render 25 hours of community service.On the suspension count he was sentenced to serve 30 to 60 days in the county prison and pay a fine of $1,000. On a charge of possession of drug paraphernalia, he was fined $100.He will serve the jail term on consecutive weekends beginning June 19 at 7 p.m.Nicole Angelique Comitino, 34, of Nesquehoning, was placed on probation for six months.She was arrested on May 22, 2014, along Market Street by Summit Hill police. A test showed 0.25 BAC.She was also fined $300 and ordered to render 25 hours of community service.The five defendants must each pay court costs of about $1,000, and a $50 per month supervision fee while on probation or parole.
