A neighbors' dispute in Summit Hill ended up in the county court on Tuesday with one person pleading guilty to a criminal charge before Judge Joseph J. Matika.
Ann Marie Derby, 51, of Summit Hill, pleaded to one count of terroristic threats for an incident on April 2 along West Holland Street.Borough police responded to the area for a dispute with Derby and her neighbor, Kim Graver. The police report stated that the two had a dispute over leaves on the ground where one parked. The report also stated that Derby threatened Graver, which led to the charge.Graver told the court that the dispute with Derby has gone on "for 20 years." She also said she was assaulted the day of the incident, which was disputed by Derby and her attorney.Derby told the court she has been a "good resident" of the community and submitted several letters from borough residents supporting her and noting her volunteer work in the community.Defense Attorney Matthew J. Mottola, of the public defenders office, said it was an "unfortunate dispute with a neighbor."Matika said, "I know both parties for a long time. They don't get along." Matika also disputed Derby's contention she was only yelling and arguing with Graver. He said, "You were threatening her."Matika said there was no way the court could turn the situation around and get the parties to get along. He told both that they had to try to just ignore each other, adding he knew that is a difficult situation since they live on adjoining properties.Matika placed Derby on probation for a year and ordered her to attend and complete anger management counseling, pay court costs of about $1,000, pay a $50 per month supervision fee, and have no contact with Graver.
