Defendant gets state prison term for bringing drugs into county jail

A Carbon County man was sentenced to a state prison term on Thursday in the county court after previously admitting bringing illegal substances into the county prison.

Michael Macaluso, 44, of Nesquehoning, was sentenced by Judge Joseph J. Matika to serve one to two years in a state correctional institution on a charge of possession of a controlled substance-contraband into a prison. The drug was identified as suboxone.He was arrested on Aug. 16, 2013, when he was brought to the county jail on another charge. During the process of being placed in the prison, corrections officers found the illegal substance in a cell phone Macaluso had on him.Macaluso said he has been fighting a drug addiction problem for five years. He said when he was picked up on a warrant he knew he had the controlled substance in his phone but didn't know whether to tell authorities or keep quiet. He said either way he knew he would be charged with a drug offense.Macaluso said of his drug addiction, "I've lost everything." He said he has children he hasn't seen in a long time and now won't until his state prison term is done.Because of a long prior criminal record, state sentencing guidelines recommended a state prison term be imposed.In addition to the jail term, Matika ordered Macaluso to get a drug and alcohol evaluation and follow any recommendation for treatment, zero tolerance imposed on D&A use, supply a DNA sample, pay court costs, which average about $1,000, and when released on parole render50 hours of community service.Following the sentencing, Matika conducted a probation revocation proceeding based on a petition filed by the county's adult probation office. Macaluso was on probation when he was arrested on the drug count and the probation was violated.He admitted the violation and was resentenced to serve six to 12 months in a state prison, but it runs concurrent with the drug charge.Matika gave him credit for 190 days spent in jail to date on the drug count and 21 days credit on the probation violation sentence.
