Quakake man resentenced after probation is revoked

An area man, currently in a state correctional facility, appeared on a video conference call before President Judge William E. Baldwin, seated in the video conference hearing room at the Schuylkill County Courthouse, and was re-sentenced after his probation was revoked.

Franklin J. Kunkel III, 22, of Quakake, Rush Township, was told by Baldwin he had been accepted into the state Immediate Punishment Program (IPP) and was being sentence on charges of criminal conspiracy, retail theft, and receiving stolen property, to which he had pleaded guilty in the county court on Aug. 15, 2012.He originally was sentenced to serve 24 months in the county's IPP but it was revoked and he was sent to the state facility to see if he qualified for the state program.Baldwin told Kunkel he shall be confined in a state correctional facility for at least seven months, with a minimum four months placement in an alcohol and other drug therapeutic community.Upon successfully completion of his rehab in the Institutional Therapeutic Community, he would have a minimum two month placement in a community based alcohol and drug and other drug therapeutic community followed by a minimum of six months outpatient alcohol and other drug treatment for a total of at least eight months of supervised integration into the community. The total duration of the IPP is 24 months.Kunkel was cited by Rush Patrolman Carl Bachart, on Dec. 8, 2011, with retail theft of multiple electronics equipment from Wal-Mart Store in Hometown.RevocationsKelly Sue Reigle, 41, Mount Carmel, had her parole revoked by Baldwin and her 50 days of liberty while on parole was disallowed and were added to her maximum date.However, the court decided to give her a second chance and granted immediate parole with stipulations she must undergo drug and alcohol evaluation and continue to participate in the Northumberland County Behavioral Health Treatment Court Program. Also on a count of defiant trespass her parole was revoked and she was re-sentenced to serve 12 months probation consecutive to the 12 months probation on the retail theft charge.Reigle was cited by Saint Clair Patrolman Martin Sterner, for retail theft of a CD from Wal-Mart Store. She originally pleaded guilty to the charges on Feb. 16, 2011, and was placed on probation.Her probation was revoked in February a 2012 and she was released with 12 months added to her probation. This was her second revocation.Bridget Ann Steffie, 34, Pottsville, had her parole revoked by Baldwin and her 413 days of liberty were disallowed and she was remanded to the county prison. The court will not entertain any petition for parole before Feb. 19, 2014.Steffie was cited by Pottsville Patrolman James P. Englert, on June 16, 2011, and was charged with forgery of a credit card and served 14 days in the county prison and was released on parole.Christopher Lance Buck, 27, Ashland, had his parole revoked by Baldwin and he was remanded to the county prison. The court announced it would grant re-parole on Oct. 3 with the condition that Buck be admitted to a drug and alcohol treatment facility.Buck had pleaded guilty last May 13 to fleeing police and after spending 30 days in the county prison was released on parole. He was cited by Ashland Officer Richard Haraschak III.Turn over evidenceAnthony Michael Ballard, Philadelphia, filed a discovery motion to court to learn what evidence the Commonwealth had to prosecute him on homicide charges filed by Pottsville Patrolman Brian Reno.Baldwin ordered the district attorney to make available all phone recordings from the Schuylkill County prison and provide the results of the search warrants to the defense for the period of two days of receiving information as to the Facebook page and telephone records.Ballard is charged with the murder of Elijah Carraway, 19, whose body was found last June 15 in an alley on Laurel Boulevard, a block away from the county courthouse.
