A Tamaqua woman who pleaded guilty to charges of forgery and retail theft was sentenced to serve two months to 23 months in the Schuylkill County Prison by President Judge William E. Baldwin.

April Lynn Miller, 34. of 4 Cherry Street, Tamaqua, on two counts of forgery and one count each of attempted forgery of checks, receiving stolen property and attempted theft, received a sentence of one month to 17 months and ordered to make restitution of $425 Joseph Thomas, She was cited by Corporal Henry Woods, Tamaqua Police. On a charge of retail theft from the Family Dollar Store in Tamaqua she received a sentence of one month to six months in the county prison to be consecutive to the forgery sentence. She also must pay $100 to the CJEA fund, She was cited by Chief Dave Mattson, Tamaqua Police.Long DUI sentencesAnelle Homovich, 32, Saint Clair, pleaded guilty to driving under the influence of alcohol and was sentenced by Judge Baldwin to serve five months to five years in the county prison, fined $1,500, pay $300 to Substance Abuse Education fund, $50 to Criminal Justice Enhancement Account, and make restitution of $60 to the Schuylkill Medical Center-South. When released on probation she must pay a $50 monthly fee for each month on probation, receive outpatient treatment and perform 20 hours of community service. Homovich was cited by Patrolman Alan Klouser, Minersville Police.Robert Fitzpatrick, Schuylkill Haven, formerly of Valley View Village, Hegins Township, pleaded guilty to driving under the influence of alcohol and was placed by Judge Baldwin in the Intermediate Punishment Program to serve five years on probation including 90 days under house arrest with electronic surveillance and pay a $12 daily fee. He also was fined $1,500, pay $100 to the Substance Abuse Education fund, $100 to the Catastrophe fund, a $50 monthly fee for each month on probation, complete 40 hours of community service, his driver's license is suspended 18 months and for 12 months must drive with an ignition interlock on the steering wheel of his vehicle which will monitor any alcohol he may ingest. He was cited by Schuylkill Haven Police.Johnny Baker, 33, Shenandoah, pleaded guilty to driving under the influence of alcohol and was sentenced by Judge John E. Domalakes to serve three months to six months in a state correctional facility, fined $1,000, pay $100 to Substance Abuse Education fund, $50 to MCARE fund and when placed on probation to attend an alcohol highway safety school, receive substance abuse outpatient treatment, submit to random urine tests, perform 10 hours of community service and his driver's license is suspended 12 months. Baker was cited by Patrolman William Curilla, McAdoo Police.Return stolen gunDistrict Attorney Karen Byrnes Noon informed the court the Commonwealth had no further use of a gun which is being held in custody by Kline Township Police because the case was closed. The gun was stolen by Francis Howie Kephart, 22, of 315 Donley Run, Weatherly, from the home of Russell Postupack, 1109 Silverbrook Road, McAdoo during the summer of 2011 when Kephart was employed by a contractor to assist in renovation of Postupack's home. He sold the gun to a sporting goods store which was recovered by Kline Township Police during their investigation. Kephart pleaded guilty to theft and is serving a nine months to 23 months sentence in the county prison imposed by Judge Domalakes on April 18, 2012. At the conclusion of the hearing the court ordered Kline Township Police to return the shotgun to its ownerUnable to stand trialAfter a hearing in court Mario Ruano, 43, of 120 Center Street, Tamaqua, was declared by Judge Domalakes to be incompetent to stand trial after hearing testimony from Dr. Larry Rotenberg, an expert psychiatrist, who evaluated the defendant on order of the court. The doctor testified Ruano did not appear to understand the nature of object of criminal prosecution. The Commonwealth did not contest the doctor's findings. Judge Domalakes then issued an order for Ruano to be committed for a period of 60 days for treatment. Ruano was charged by Chief Dave Mattson, Tamaqua Police, with aggravated assault, terroristic threats, simple assault and harassment of Irma Martinez, `20 Center Street, Tamaqua.
