Thirteen first time offenders placed in probation program

Thirteen first time offenders in the criminal justice system were placed in Carbon County's Accelerated Rehabilitation Disposition (ARD) probation program this week by county judges.

If a person successfully completes all conditions of the program their record is wiped clean. However, if they fail to complete the program, or are revoked from it, they would face trial on all pending charges. A person does not admit guilt in entering the program.All were placed for a year, unless otherwise noted.Placed by Judge Steven R. Serfass were:Robert G. Doleiden, 63, of Allentown, was placed for six months on a driving under the influence (DUI) charge. He was arrested on June 21, 2012, by Lehighton police at the intersection of Bankway and Bridge sts. Given a test, the result was .04BAC.He was assessed $450 for the cost of the program and ordered to get a drug and alcohol (D&A) evaluation and follow any recommendation for treatment, and his license was suspended for 60 days.John FM Evans, 48, of Summit Hill, was placed for two years on a charge of simple assault. He was arrested on Sept. 24, 2011, by Lansford police for an incident at the Panther Valley Football Stadium. He was involved in an altercation with a 13-year-old male punching the teen in the face, police said.He was assessed $650, and ordered to render 100 hours of community service, attend and complete anger management counseling, and write a letter of apology to the victim and his family.Justin T. Kibler, 23, of Lehighton, was placed on a DUI charge. He was arrested on Sept. 26, 2012, along SR209 in Lehighton by state police. Given a test, the result was .08BAC.He was assessed $450, and ordered to get a D&A evaluation, and render 50 hours of community service.Joseph Laponuke, 48, of Lehighton, was placed on a DUI charge. He was arrested on Aug. 18, 2012, along Mauch Chunk St., in Mahoning Township, by township police. Given a test, the result was .09BAC.He was assessed $450, and ordered to get a D&A evaluation, and render 50 hours of community service.The following were placed in the program by Judge Joseph J. Matika.John Joseph Harkins IV, 34, of Catasauqua, was placed on a DUI charge. He was arrested on July 4, 2012, along SR248 in Palmerton by state police at Lehighton. Given a test, the result was .13BAC.He was assessed $500, and ordered to get a D&A evaluation, license suspended for 30 days, and render 50 hours of community service.Travis L. Lunden, 20, of Walnutport, was placed on a charge of possession of a small amount of marijuana. He was arrested on July 7, 2012, by state police at Lehighton following a vehicle stop at the intersection of state routes 209 and 248 in Franklin Township.He was assessed $450, and ordered to render 50 hours of community service.Eric Christopher Mack, 20, of Walnutport, was placed on a DUI charge. He was arrested on July 7, 2012, near the intersection of state routes 209 and 248 in Franklin Township. Given a test, the result showed the presence of a controlled substance.He was assessed $600, and ordered to get a D&A evaluation, license suspended for 90 days, and render 50 hours of community service.Heather McHose, 21, and Shawn Andrew McHose, 19, both of Nesquehoning, were placed in the program for two years each on various drug related charges. They were arrested by Nesquehoning police for their involved in the sale of synthetic drugs at the Solo Service Station in the borough. The time frame was in February and March, 2012.Each was assessed $650, and ordered to render 100 hours of community service, and each must testify for the Commonwealth at any trial involving their co-defendant, Asad Bajwa, 23, of Tamaqua R.2.Brian Scott Schleicher, 48, of Lehighton, was placed on a charge of theft by unlawful taking. He was arrested on July 10, 2012, by state police at Lehighton, for an incident in which he allegedly took 310 gallons of diesel fuel from construction equipment of Walsh Construction, which was parked along Lehigh St., in Bowmanstown.He was assessed $450, and ordered to render 50 hours of community service.Matthew Thomas Stephens, 22, of Middleport, was placed on a charge of burglary. He was charged by Lansford police for his part in the entry of a residence at 304 E. Bertsch St. that occurred on Sept. 8, 2012.He was assessed $650, and ordered to render 50 hours of community service, make restitution in an amount to be determined by the adult probation office, and must testify at trial against a co-defendant, Melvin Gerber.Shane Douglass Stoops, 23, of Middleport, was placed on a burglary charge. He is a co-defendant with Stephens.He was assessed $650, and ordered to render 50 hours of community service, make restitution to be determined, and testify at trial against Gerber.Matthew M. Wallis, 41, of Whitehall, was placed on a DUI charge. He was arrested on June 2, 2012, along SR209 in Franklin Township by state police at Lehighton. Given a test, the result was .20BAC.He was assessed $550, and ordered to get a D&A evaluation, zero tolerance imposed on D&A use, and render 50 hours of community service.Each defendant must also pay court costs, which average close to $1,000, and pay a $50 per month supervision fee while in the program.
