Coaldale man found not guilty of assault; other cases heard

A Coaldale man was found not guilty by a jury of charges of simple assault and harassment after a one day trial in Schuylkill County court.

Robert C. Perron, 47, of 235 First St., denied the charges which arose out of a domestic dispute between him and his girlfriend, Paula Seblin, which occured last Sept. 7 at Perron's home.She claimed she was assaulted and suffered a lump on her head and a cut on her wrist. Perron denied the assault, claiming he was attempting to get her to leave the home and that she bumped her head against the stove.Testimony was an argument started the day before when Seblin discovered a record of a phone call to Perron from an ex-girlfriend and demanded he call the former girlfriend and tell her not to be calling him and when he refused he claimed she harrassed him that night into the next day.The case was tried before Judge John E. Domalakes.Found guiltyJames Curtis Stevens, 21, of 321 Cherry St., Shenandoah, was found guilty by a jury of six counts each of aggravated assault, simple assault and recklessly endangering another person; three counts of discharging a firearm in an occupied home; and one count of possession of a firearm not to be carried without a license.President Judge Willliam E. Baldwin deferred sentence to a later date, requesting a pre-sentence investigative report prepared by the adult probation department and increased the bail on Stevens.He was charged by Shenandoah Patrolman Michael O'Neill, for firing three shots inside the residence at 313 S. West St.Not guiltyLeo A. Leinheiser Jr., 41, of 148 Water St., New Philadelphia, was found not guilty of a charge of receiving copper wire stolen from the East Penn Deka Company garage in East Norwegian Township.He was tried before Judge Jacqueline Russell.Pleads guiltyZachary Guy Zerby, 18, of 204 E. Broad St., Tamaqua, pleaded guilty to driving under the influence (DUI) of drugs and was sentenced by Judge John E. Domalakes to serve 72 hours to six months in the county prison, fined $1,000, pay $100 to Substance Abuse Education fund, $50 to MCARE fund, $60 to Schuylkill Medical Center, attend alchohol highway safe driving school, receive intensive outpatient treatment, perform 10 hours of community service, pay a $50 monthly supervision fee, and his driver's license is suspended 12 months.Zerby was cited by Mahanoy City Officer Jonathan McHugh.James Malcolm Thomas, Saint Clair, pleaded guilty to DUI of alcohol and was sentenced by Judge Domalakes to serve 30 days in the county prison beginning Wednesday, Oct. 24, at 9 a.m., followed by four years and 11 months on probation in the Intermediate Punishment Program, fined $1,500, pay $300 to Substance Abuse Education fund, $100 to Catastrophe fund, $60 to Schuylkill Medical Center, attend safety school, complete outpatient substance abuse treatment, perform 20 hours community service, license suspended 18 months, and for 12 months must install an ignition interlock on his vehicle.Thomas was cited by Trooper Timothy J. Rymnarkiewicz when stopped on SR183 in Wayne Township.Revoke paroleZachary Allen Kadingo, 24, Schuylkill Haven, had his parole revoked by Senior Judge D. Michael Stine and he was recommitted to the county prison to serve his original sentence with his 163 days of liberty disallowed. He shall be eligible to reapply for parole on or after Nov. 15.Kadingo pleaded guilty to charges of possession of a small amount of marijuana and drug paraphernalia and was placed on probation in August 2010.Child pornographerRay Allen Shoup, 38, Mahanoy City, pleaded guilty to 15 counts of possessing on his computer pornographic pictures of pre teen girls.The guilty plea was accepted by Judge Domalakes who ordered the defendant to submit to an evaluation through the states sexual offenders assessment board and sentence was deferred pending the evaluation.Shoup was cited by state police Cpl. Paul Smith.
