Joe Ehritz, under public comment, told East Penn Township supervisors on Sept. 4 that when they enforce the court order against Clair Troxell trucks should be removed from a repair facility. The community center that was bought by Troxell never had a changed of use to storage.

Resident Harvey Keiper said he took zoning officer Rich Dietrich to see where Troxell has three turnpike trucks parked in a residential area."This guy is above the law. Go after Robert Balliet (the landowner). This guy just thinks its funny," said Keiper.Dietrich said he saw no problem.Solicitor Jim Nanovic said there is no final court decision. An enforcement notice was given and he was taken to the magistrate. The $624,500 fine still stands against Troxell.Supervisors Chair Dean Kercsmar said he would have Secretary Deanna Cunfer pull the nuisance ordinance to see if that offers any help.Ehritz said when bids are opened the amount should not be given until the township is sure it will be awarded. In case of rebidding the knowledge would be beneficial to new bidders.Loretta Smith, a resident on Blue Mountain Road, said she cannot get supervisors to oil and chip the road even where dirt is showing. Kercsmar said someone would be out to check the condition of the road.Resident Nancy Blaha asked supervisors to reconsider the time of the meeting moving it back to 7 p.m. From the audience many people were heard to say "second that motion." It will be considered prior to reorganization, said Kercsmar. He is one of the people who have to take off from work in order to make the 5 p.m. meetings.Corey Smith, roadmaster, said Blue Mountain, Hollow and Germans roads are scheduled for work and Municipal is on next year's schedule.Electronics recycling will be held Sept. 24, 9 a.m. to 2 p.m., and Sept. 25, noon to 6 p.m. at the Lehighton Borough Garage on East Penn Street. The garage is across from Snyder Tires off Route 443 at the traffic light west of Pizza Hut.Assistant East Penn Fire Chief Robert Kleintop asked if the fire company could lease or have donated land on which to build a pole building. It would be built with grant money and be a fire company investment."We want to be sure the land won't be sold from under us. If it is sold we want our investment back," said Kleintop.Kercsmar said it would protect the township also.Nanovic said it would have to be a lease because a donation would leave less land on the township mortgage and it would have to be remortgaged. He will draw up a simple agreement.An emergency generator will be given to the township without charge. Alternatively, Smith had bids for new generators. He made a motion to install the donated generator. The work will be done by Ron Neff Electrical Service.Engineer Bruce Steigerwalt said he needs a notice of intent to renew the Municipal Separate Storm Sewer system permit. It requires public education on stormwater discharge, runoff and pollution prevention.The MS4 permit application requires a signature on the letter of authorization and a $500 check. Cunfer was authorized to sign it.The township police were authorized to work at home football games. The township will be reimbursed for the cost.Excess township equipment will be sold on Sept. 27 including a 1998 Ford Crown Victoria.Twenty-three trees will be removed along Municipal Road at a cost of $5,200 by K&K Tree Service.Centax as delinquent tax collector has been transitioned to Berkheimer.Employees will be paid by direct deposit beginning in January or sooner.Blue Cross was renewed for the period Oct. 1, 2012 to Oct. 1, 2013.
